Looking for an exciting job opportunity with the potential for a 10-year commitment? Apply today: Cartel coordinator wanted I have tried over the years to follow the literature in antitrust. I recall reading an article years ago about a cartel that had been cracked by competition law enforcement officials. There have certainly been quite a few of these over the past decades – cases involving price fixing, market allocation, bid rigging. But what made this one stand out was the example of criminal efficiency. Apparently it can be difficult to keep a price-fixing or market allocation cartel going effectively. So in this case the conspirators decided to do what executives do so well: delegate. In a burst of management insight they had hired an official “cartel coordinator.” My colleagues and I tried to imagine the job description for this coordinator position: what would the qualifications and required experience be? Was a certain level of education required? Was compensation just salary, or were there incentives and perks. Would the person be an independent contractor or hourly employee? Given that in the US engaging in a price fixing scheme can get you 10 years of Fed Time (i.e., prison), and that the coordinator might also be involved in related crimes (obstruction of justice, conspiracy, mail and wire fraud, etc.) that could merit even more jail time, we were certainly curious what the perks and pay were for this position. And especially how did they describe the nature of the work, and how the coordinator’s performance would be measured. ________________________________________________________ This was just published in today's Compliance and Ethics: Ideas & Answers newsletter. Each week we have a feature called Compliance Lite. As an antitrust lawyer, this was my contribution. (Our website is https://lnkd.in/emk_2-_x if you want to find out more about our newsletter.)

Provocative and insightful discussion led by Louis Perold and Paul H Zietsman on Compliance Strategies for Changing Board Attitudes at Society of Corporate Compliance and Ethics (SCCE) Monday morning. Thanks to Louie and Paul for the interactive and thoughtful poll questions - such as “Based on your experience, what do you believe are the primary reasons a Chief Compliance Officer left / might leave an organization you worked with?” (40% said conflicts with leadership, followed by 32% who said insufficient authority). Also affirming to be in community and strategies to protect your career in worst case scenarios (such as negotiating for an employment contract or severance contingency). Further to this, here is a recent review of CCO liability case law and other proactive actions you can take, in my recent Compliance Week article: https://lnkd.in/gMQAuxjA #compliance #ethics #careers Barnard-Bahn Coaching & Consulting

#compliance holds significant importance in today's business landscape, ensuring equitable practices within organisations and in interactions with external stakeholders, partners and customers. The Department of #legalaffairs , which manages compliance in organisations, is instrumental in upholding fairness and governance standards within an organisation. It also ensures that the organisation's global compliance initiatives are well implemented and harmonised across regions to achieve the desired outcomes. The composition of this department is diverse, and the qualifications required vary. People managing portfolios in this department need experience in legal matters, risk management, audits, and compliance. Individuals with such backgrounds are difficult to find. Hiring for compliance roles requires carefully evaluating candidates' skills, knowledge, and experience. Organisations invest a lot of time and resources to find suitable candidates. While there are many ways, like internal referrals, networking or professional associations, to find suitable candidates, organisations can engage with platforms like Bridge Et Al. Humor in the field of Compliance & Ethics? Really? In Compliance and Ethics: Ideas & Answers we decided it would be good to include some compliance-related humor in our weekly newsletter. We have been running a feature called “Compliance Lite,” where we post humorous comments or human-interest pieces related to compliance & ethics. I’d be interested to know what you think. I am also interested in any other place in our field where they regularly post things about humor in compliance & ethics. There have to be some other folks who see a place for humor in our field, yes? Please let me know if there are other places. Also, if we published a Compliance Lite piece that you liked, I’d be interested to hear. And of course, if you have a story or humorous point that relates to our field, please pass it along. We are happy to give you credit for any contributions. One story that particularly appealed to me was about how my colleague, Jeff Kaplan, dressed up in a devil’s costume as “the Devil’s Advocate” to make a point for a prosecutor.
