Dear Connections, I am delighted to share that I am successfully completed General Course on Intellectual Property organized by the World Intellectual Property Organization. During this course, I have studied the following topics- 1. What is copyright, to whom this right has been provided, Works which are protected under Copyright, Term of copyright, International Conventions governing IP. 2. What is Trademark, why it is for, to whom it protects, term of protection, etc. 3. What is a Patent, what types of inventions it protects, terms of protection, International Conventions governing it. 4. Other Forms of Intellectual properties and their protection i.e. Protection of Plant varieties, Geographical indication protection & Country of Origin, Design Protection, etc. International Convention for protecting them worldwide. 5. These are following international agreements providing fast track route to protect some of the forms of IPR in multiple Countries- Madrid system-For trademark protection Hague system- For Design protection Lisbon system- For Country of Origin Protection.

The patent application process involves several steps. Here’s an overview: Get Ready to Apply: Determine the type of intellectual property (IP) protection you need (e.g., patent, trademark, copyright). Assess if your invention is patentable. Search to see if your invention has already been publicly disclosed by another party. File Your Application: Prepare a detailed specification describing your invention. File the application at a patent office for examination. Application Prosecution: The patent office reviews your application, conducts searches, and examines its novelty. You may need to respond to office actions or make amendments during this stage. Receive Your Patent: If your application meets all requirements, you’ll receive a patent grant. Otherwise, your application may be refused. Maintain Legal Protection: Pay maintenance fees to keep your patent in force.

Intellectual property (IP) in Kenya is governed by laws such as the Copyright Act (2001), Trademarks Act Cap 506, and Intellectual Property Act (2001), along with international agreements, all aimed at protecting creativity and innovation. The Industrial Property Act incorporates international agreements like the Patent Cooperation Treaty and TRIPS, establishing the Kenya Industrial Property Institute (KIPI) to oversee patents, industrial designs, and trademarks. The Copyright Act (2001) aligns with the Berne Convention and TRIPS, offering copyright protection to authors without registration. Similarly, the Trade Marks Act governs trademark registration in Kenya. You can protect your intellectual property. Trademark your IP. Get a contract. Get a lawyer to do it for you. But STOP STEALING other people's intellectual property. Stop passing off other people IP as yours. If you're going to lift a post, acknowledge the author. If you want to use an image, credit the owner. N5 billion lawsuit over negative reviews of company products or services seem good. The claim is on the intangible assets of the company be it Copyright, Patent, Trademark, brand, Trade secrets etc. You must establish damages to these assets through valuation of the claims. The claim is beyond figure calling, the court needs details report to rest their judgement. The valuation report will show the duration of the damages, impact on the so call product or products. We need to be wise in our lawsuit on intangible assets or tangible assets.
