📢 On May 10, 2024, the Ukrainian government approved the Technical Regulation on the classification, labeling, and packaging of chemical products (“UA-CLP”). This regulation integrates the norms of the European CLP Regulation, which itself incorporates the UN-established Globally Harmonized System (GHS) for classifying and labeling chemicals. The regulation enters into force after 6 months from the publication. 📌#Ukraine Adopts Technical Regulation on Chemical Safety in Line with EU-REACH On July 23, 2024, Ukraine approved the #UA-REACH regulation, aligning with #EU-REACH standards. This ensures the safety of chemical products, protecting human health and the environment. 🔍 Key Points: Mandatory Registration: Chemicals produced, imported, or sold in Ukraine over one ton per year must be registered, creating a comprehensive database managed by the Ministry of Environmental Protection. Goals: Replace hazardous chemicals with safer alternatives, improving health and environmental protection. ➡ 𝗨𝗞𝗥𝗔𝗜𝗡𝗘 𝗥𝗘𝗔𝗖𝗛 𝗥𝗘𝗚𝗨𝗟𝗔𝗧𝗜𝗢𝗡 📅 On July 23, 2024, the Ukrainian government took a significant step towards enhancing chemical safety by approving the technical regulation on the safety of chemical products, commonly referred to as Ukraine REACH. This regulation aligns Ukraine’s chemical management framework with the European Union’s REACH Regulation. It mandates the compulsory registration of all chemical substances produced, imported, or placed on the market in Ukraine in quantities exceeding one ton per year. This requirement aims to gather comprehensive data on the properties and safe use of these substances, facilitating informed risk management decisions. The approval of Ukraine REACH represents a significant enhancement in the country’s approach to chemical safety, aligning it with European standards and practices. It underscores Ukraine’s commitment to protecting human health and the environment from chemical risks while facilitating the free movement of chemicals within the market. Protecting trade secrets in China has been a nightmare for many foreign companies, especially in consideration of the huge investments and the "slim" damages. Yet, in a recent case concluded by the China Supreme People’s Court, Sennics Chemical Technology Co., Ltd. vs. Chen and Yuncheng Jinteng Chemical Technology Co., Ltd., the Court has awarded around RMB 202 million (roughly USD 30 million) in damages, which is astronomical compared to the past trade secret rulings in China. In this case, the defendants were criminally convicted for stealing trade secrets of Sennics Chemical, but did not cease their infringements yet instead continued to use the stolen trade secrets to produce products. Based on an appraisal report which was admitted in the criminal proceedings, and also considering the 8-year duration of infringements, the Court eventually decided to uphold the awarded damages of RMB 202 million.
