📢 On May 10, 2024, the Ukrainian government approved the Technical Regulation on the classification, labeling, and packaging of chemical products (“UA-CLP”). This regulation integrates the norms of the European CLP Regulation, which itself incorporates the UN-established Globally Harmonized System (GHS) for classifying and labeling chemicals. The regulation enters into force after 6 months from the publication. Protecting trade secrets in China has been a nightmare for many foreign companies, especially in consideration of the huge investments and the "slim" damages. Yet, in a recent case concluded by the China Supreme People’s Court, Sennics Chemical Technology Co., Ltd. vs. Chen and Yuncheng Jinteng Chemical Technology Co., Ltd., the Court has awarded around RMB 202 million (roughly USD 30 million) in damages, which is astronomical compared to the past trade secret rulings in China. In this case, the defendants were criminally convicted for stealing trade secrets of Sennics Chemical, but did not cease their infringements yet instead continued to use the stolen trade secrets to produce products. Based on an appraisal report which was admitted in the criminal proceedings, and also considering the 8-year duration of infringements, the Court eventually decided to uphold the awarded damages of RMB 202 million. This is a very positive development and it shows that China is making progress to strengthen the protection of trade secrets and give confidence to both domestic and foreign IPRs.
