An insightful article featured on routeone Magazine Danny Betts, our Head of Safety, Standards and Compliance has commented: "Adhering to tachograph regulations is fundamental to ensuring road safety. Drivers' hours are regulated to prevent fatigue-related incidents, and tampering with these records, especially by pulling the tachograph card, severely undermines these safeguards. From a compliance standpoint, this behaviour should be grounds for immediate dismissal because it directly jeopardises public safety, contravenes legal regulations, and exposes the company to significant liability. Transportation companies need to enforce strict policies and cultivate a culture of compliance, where the rules around driving hours and tachograph use are non-negotiable." Stay Aware for Everyone (SAFE) Act The third bill – the Stay Aware for Everyone (SAFE) Act – will tackle the threat of distracted driving, a problem that is only increasing with the proliferation of “driver assistance” technologies that can encourage complacency if misused on the road. The SAFE Act will specifically require the DOT to study how driver-monitoring systems can prevent driver distraction, driver disengagement, automation complacency, and the foreseeable misuse of advanced driver-assist systems. The legislation also requires a rulemaking to mandate the installation of driver-monitoring systems based on the results of this study, which shall incorporate appropriate privacy and data security safeguards. #seeingmachines A copy of the SAFE Act can be found HERE. Senator Amy Klobuchar (D-Minn.) is also a cosponsor of this legislation. https://lnkd.in/eF9SS5qB

Happy Hump Day all! Yesterday Mutha Trucker News and John Seidl posted a piece with a headline indicating a driver was placed OOS for no bedding. https://lnkd.in/e76Kx6jj I struggle with the rumor mill and have to shake my head at the nonsense spread and people sharing the data without at least trying to verify the information was semi-factual. I've seen Tic Toc videos where a creator used the photo that Mutha Trucker News used. The TT creator claims the driver had a sleeping bag without a pillow, there was a discussion between the MCSAP officer and driver that grew heated and the driver was placed OOS for not having bedding. 🙄 John Seidl is correct the Commercial Vehicle Safety Alliance publishes the OOS Criteria; however, the OOS Criteria is developed by a board consisting of MCSAP law enforcement officers, carriers, manufacturers and the FMCSA. "The Commercial Vehicle Safety Alliance is a nonprofit association comprised of local, state, provincial, territorial and federal commercial motor vehicle safety officials and industry representatives." https://lnkd.in/egUEVnQR In 2002 Joe Clapp the first official FMCSA Administrator decided that FMCSA staff should know what a truck is and launched the program to mandate that FMCSA Safety Investigators and later Safety Auditors should know what a truck is. John made a remark about every state LEO was forced to participate in International Road Check. The FMCSA requires all North American Standard Truck inspectors to have the 80 hour (Level 1, 2, or 3 inspections) or 40 hour (Level 3 driver only) training, 32 inspections with a qualified inspector and 32 inspections a year to remain qualified. https://lnkd.in/eYQTPXiD Forgive me, I digress. I doubt the driver was placed OOS for bedding. Question 2 of the interpretations for Part 393.76 states: Question 1: If a compartment in a CMV is no longer used as a sleeper berth, must it be maintained and equipped as a sleeper berth as required in § 393.76? Guidance: No. IMHO a sleeping bag is "Adequate bedclothing and blankets;" however, if a driver was being an ass the Commercial Vehicle Safety Alliance MCSAP officer may have denied the bedding met the standard and placed the driver OOS for Part 395.8(e) false log for logging sleeper berth when the SB didn't meet the equipment standards. IMHO this would be a simple DataQ challenge and the applicable state should remove the OOS, if this was the case. 😉 Hope everyone is enjoying their week! Be safe.

“Naughty some more, Police 🚓will catch you!!” Have you heard of that when you were young? I bet we did, oops, not exposing your age here. Discipline and compliance had taken a turn with science and data based research. Here is an article from CNA by Han Fook Kwang that seems to suggest that we should be harsher with minor violations and I’m All For it!! There are no good reasons for one to flout the rules and laws just for the extra dollar or single minute. Not only do I urge the authority #LTA to make the road safer by enforcing the full force of the law on anyone but all transportation companies as well as food delivery or service platforms to change their reward schemes to include being a good and safe driver while in service. Installing telematics is the last resort to deter errant drivers. We need to do better in this aspect as life matters and 🧑🧑🧒🧒family can be shattered because of an “airhead” on the road.
Commentary: To improve road safety, we must not let drivers get away with minor infringements

#HowToReduceRoadAccidents#.... To reduce road accidents, it's crucial to focus on specific safety precautions. Here are five main precautions that can significantly contribute to improving road safety: #StrictAdherenceToSpeedLimits:# Enforcing and obeying speed limits is one of the most effective ways to prevent accidents. Speeding reduces reaction time and increases the severity of collisions. Implement strict speed limits and use speed enforcement measures such as speed cameras to discourage speeding. #ZeroToleranceForDrivingUnderTheInfluence(DUI):# Driving under the influence of alcohol or drugs significantly impairs judgment and coordination, increasing the risk of accidents. Strictly enforce laws against DUI, conduct regular sobriety checkpoints, and educate the public about the dangers of impaired driving. #PromotionOfSeatBeltUsage:# Wearing seat belts is a simple yet highly effective precaution that reduces the severity of injuries in the event of a collision. Implement and enforce seat belt laws, and conduct public awareness campaigns to emphasize the importance of seat belt usage for both drivers and passengers. #EliminationOfDistractedDriving:# Distracted driving, often caused by activities like texting or talking on the phone, can lead to accidents. Implement and enforce laws against distracted driving, and educate the public about the risks. Encourage the use of hands-free devices and emphasize the importance of focused attention while driving. #RegularVehicleMaintenance:# Well-maintained vehicles are less likely to experience mechanical failures that can lead to accidents. Encourage regular vehicle inspections and maintenance, including checks on brakes, tires, lights, and other essential components. Promote awareness of the importance of vehicle maintenance among drivers. These precautions address some of the major contributors to road accidents, focusing on factors such as speed, impairment, restraint usage, attention, and vehicle condition. Implementing and enforcing these measures, along with ongoing public education, can contribute significantly to reducing the number and severity of road accidents.

“there is never, ever a lawful excuse for a professional driver to remove their digital tachograph card from the digital tachograph machine and then to carry on driving an in-scope vehicle.” - Miles Dorrington, TC for the West Midlands. https://lnkd.in/dk8QTg76 I have worked with a few operators who were under the misconception that a card was not needed in some certain, and rather unspecific circumstances, I very quickly dispel that myth. They don't want to hear it, they may not like it. But if they want me to be a TM or consultant for them, then they will have to take heed. And yes, there are exemptions, but you need to be damned sure that you qualify before using one. #legalcompliance #transportcompliance #lgvtraining #psvtraining #transportconsultant

Do Not Underestimate The Importance of Rearview Mirror. Dear Fleet Managers, The rearview mirror is a critical component for safe driving, providing essential visibility of the vehicle's surroundings and helping to prevent accidents. Operating a vehicle without a functional rearview mirror significantly compromises safety, as it limits the driver’s ability to see and respond to other vehicles and hazards on the road. Here are some key reasons why a functional rearview mirror is non-negotiable: 📍Enhanced Visibility: The rearview mirror allows drivers to see what is happening behind and alongside the vehicle, which is crucial for making safe lane changes and turns. 📍Accident Prevention: A broken mirror can lead to blind spots, increasing the risk of collisions with other vehicles, pedestrians, or obstacles. 📍Legal Compliance: Operating a vehicle without a working rearview mirror may violate traffic laws and regulations, leading to fines or penalties. 📍Driver Confidence: Ensuring all mirrors are intact helps drivers feel more secure and confident, reducing stress and the likelihood of errors on the road. 📍Professional Responsibility: As fleet managers, it is our duty to maintain high safety standards and ensure that all vehicles are in optimal condition before they hit the road. Please make it a strict policy to inspect and repair any damaged mirrors before allowing a vehicle to embark on a trip as safety should never be compromised, regardless of how minor the concern might seem. This small but vital measure will go a long way in protecting your drivers, assets, other road users and enhance overall safety and efficiency of your fleet operations. #fleetmanagement #fleetsafety #userofrearveiwmirror #fleetmanagers
