Pro's and Con's to an Escalation Clause An escalation clause is when a buyer writes into their offer that they will pay a certain dollar amount above the seller's current best offer to buy the property. From a strategy perspective this is great if you're a buyer because it can give you the peace of mind that you didn't over pay. If you're a seller this can actually slow down the bidding velocity in a multiple offer situation which will keep the price down and it is an extra step in the process to lock in an executed contract. For our buyer clients we always try to negotiate using escalation clauses in multiple offers situations if the seller allows it.... For that same reason... For our seller clients we always recommend setting highest and best deadlines where no escalation clauses are considered. This helps sellers drive the price up and keep the contingencies of the contract low. Which in most cases is the ultimate goal of the seller. In this market your strategy matters. Changes are coming to real estate transactions effective August 17th, 2024. As of this date, buyers working with an agent to purchase a property are required to have a signed Buyer-Broker Agreement in place that specifies the agent''s compensation before a property can be toured. Sellers can still offer compensation to a buyer-broker but it can no longer be offered in the MLS and there may be a difference in what sellers are offering in compensation and the compensation specified in the Buyer-Broker Agreement. So a buyer may be on the hook for some or all of their agent's compensation. Negotiations in broker compensation will likely become a common part of a real estate transaction. Heading into August, there will be some confusion and a bit of a bumpy road initially in real estate transactions until the dust settles and the new policies are ironed out. Now more than ever it is important to have an experienced agent ready to assist you in purchasing or selling a property to help guide you through these changes. I have 26 years of experience, I am keeping up to date on the latest information on these changes and I am ready to get to work for you.
