#AppealsandGrievances folks take notice! CMS released the 2025 Advance Notice yesterday #CMSAlert including a proposal that will change how the Independent Review Entity (IRE) defines and calculates timeliness for the Star measures. Currently, the IRE includes additional days to account for mail delays; however, 99% of cases are now submitted electronically via the portal. The proposal would remove the 5-day grace period for electronically submitted appeals, but leave the buffer in place for that rare exception in which a hard copy is mailed. In addition, CMS is considering using the electronic system receipt date and time as the date the appeal was received by the IRE even when it’s after the IRE’s business hours. Using this date will more accurately reflect the actual submission from the plan. Note that hard copies delivered outside of the IRE’s normal business hours will continue to reflect the following business day as the receipt date. This is your opportunity to provide feedback to CMS and help shape the process. CMS is accepting comments through 6:00 PM Eastern on Friday, March 1, 2024. What should I do? Think through your current processes, the regulatory timeframes, and your member and provider needs. Consider the following: • Should CMS consider adjusting the submission requirements to be within 24 hours of expiration of the regulatory timeframe to allow plans, providers, and members the full timeframe? • Should the requirement be by the end of the first business day following expiration of the timeframe? • How will you operationalize, track, and monitor any change that emerges? Remember to provide a rationale for your suggestions when you submit your comments. Many times the practical, operational concerns are overlooked and it’s your responsibility to use your voice to bring them to light. Final thought CMS considers these proposals to be a substantive change in process. This means they would be tested as display measures prior to moving to the Part C Star ratings.
