Everyone (well, almost everyone) agrees that prior authorizations present barriers to care. But there's not much of a consensus on what to do with them. Recent CMS rules designed to speed up prior auths don't yet have any enforcement actions tied to them. Eliminating prior auths entirely won't fly with insurers -- it'd drive up waste, fraud, and utilization. So what's a poor health system to do? One doctor wants to designate time spent handling prior auths with insurers as a billable CPT code. If that were to happen, he argues, insurers may be more judicious in applying prior auth requirements and in hurrying those processes along. They'd have too much financial skin in the game not to.

New HIPAA rules require updates to privacy practice notices for healthcare providers, health plans, and healthcare clearinghouses. Sadly, recent encounters confirm many health care providers notices and authorizations violate existing rules. Examples of common mistakes recently encountered in just my family’s recent annual medical checkups include: *Conditioning care on authorization, indemnification or other inappropriate requirements * HIPAA authorization not include required language * HIPAA authorization mixed with other authorizations and acknowledgements * Privacy Notice not exist or provided but practice requires ,not requests acknowledgement of receipt *Privacy notice not posted in treatment rooms or on website * Digital portals impose conditions on use/access inconsistent with HIPAA *Many others After helping covered entities and business associates with HIPAA compliance since its enactment, we know these and other mistakes can trigger huge penalties, investigation and defense costs. Engage qualified experienced legal counsel with demonstrated experience to review and correct your firms and processes within privilege.
