In Massachusetts, even when the property is up for sale, tenants have rights. That means you, as their landlord, need to honor the terms of their lease. If the tenant is on a fixed-term lease, they have the right to stay until the lease ends—unless both parties agree to move out early. If the tenant is on a month-to-month lease, you’ll need to give them proper notice if you plan to terminate their tenancy. In some cases, you may also need to offer a “cash for keys” deal to help them relocate before the sale.
