We all love a public holiday 😊 and with the Grand Final holiday coming up on Friday here in Victoria (and Melbourne Cup Day not far behind), we thought it was timely to talk about some of the grey areas surrounding working or not working them. 👉 Sometimes, employees may ask to swap the day off for another day. While most Awards and some Agreements allow for this, it’s important to double-check, as in some circumstances the employee may still be entitled to be paid penalty rates for working the public holiday. 👉 We often get questions about whether or not an employee can refuse to work a public holiday. Ultimately, several factors come into play in determining this, including the business's operational requirements, the nature of the work performed by the employee, and the employee’s personal family responsibilities. AUSTRALIA DAY PUBLIC HOLIDAY | With the upcoming Australia Day public holiday, you should (if you haven’t already) ensure you understand your public holiday entitlements and obligations. Some important points to remember are that: - Employees have the right to be absent from work on a day or part-day that is a public holiday, except where they are reasonably requested to work and any refusal is unreasonable. - In determining whether requests or refusals are reasonable, certain matters must be considered, such as the nature of the employer’s workplace (including its operational requirements). - The case of CFMMEU v OS MCAP Pty Ltd [2023] FCAFC 51 found that employers must first request whether their employees are willing to work on public holidays, rather than unilaterally requiring or rostering their employees to work. - Permanent employees are entitled to be paid their base pay rate for their ordinary hours if they are absent from work because of a public holiday. - An employee is not entitled to payment if they do not have ordinary hours of work on the public holiday. - Some awards and enterprise agreements may have substitution rules. Holidays and breaks from work are necessary to recharge the brain and the body...not to mention a legal entitlement! As company leaders and managers, we have an obligation to: 💫 lead by example and to enjoy our own holidays without being contactable 💫 ensure that handovers and cover is agreed in advance and clear to all that need to know, so that contact is not made And we've said it before, but we'll say it again...beware the martyr who resists any sort of handover so they are the only person that can help with something whilst they are on holiday. They are not helping themselves, and they are not helping business continuity...be firm around expectations whilst they are away! This topic also links with a 'right to switch off' that is more common on the continent and could become a focus here with the new government. The same principles apply where thought needs to go into how businesses are structured to enable everyone to enjoy and benefit from real time off. #holidaytime #summerholidays #righttoswitchoff #rolemodelling

Very bad lighting but I love this London Underground poster by British Airways Holidays The 2024 annual leave report by Access PeopleHR highlights that the amount of annual leave taken between 2022-23 has droped by over 7.5% and 12% since 2020. 🤷🏻♀️So what are the reasons for this decline? Whether its a result of business expectations, shortage of staff,, blurred lines or fear of failing, these are all disguise words for CULTURE, CULTURE, CULTURE. As business leaders it’s important to actively encourage annual leave if you want to succeed in creating a culture of engagement, productivity and happiness. In addition to this, its really important to lead by example, demonstrating to your teams that the world keeps turning without you. So tell me, do you….. A) take all of your entitlement?. You’ve earnt it. B) take your holiday but you’re always “on duty”? C) lose some of your entitlement?
