We’re excited to see New Hampshire’s proactive efforts to destroy #PFAS getting the attention they deserve, including recent coverage by New Hampshire Public Radio. This past Wednesday, we were in Concord, collaborating with state officials and firefighters to collect PFAS-laden #AFFF for destruction at one of Revive Environmental's permitted facilities in Ohio. As our CEO David Trueba emphasized, “Every gallon of foam collected and destroyed responsibly means preventing groundwater contamination. This leads to healthier citizens and cleaner drinking water.” The significance of this initiative is immense, and we’re proud to play a part in creating a cleaner, safer future. Historic industrial contamination, especially from carcinogenic chlorinated solvents such as TCE and PCE, continues to impact the lives and safety of the surrounding communities decades after the industrial operations have closed. Many of these abandoned sites, often referred to as Brownfield or Superfund sites, ceased operation prior to the full enforcement of national environmental protection laws in the 1980's, and often created environmental contamination zones spreading far beyond the property line. Unfortunately, this means that there are contaminated properties that have been under investigation by regulatory agencies for decades that may pose a substantial #vaporintrusion risk to the surrounding communities. Chlorinated solvents can remain in the environment for decades after they are released and can cause harm even at low levels when ingested or inhaled. EPA Finally Designates PFOS and PFOA as CERCLA Hazardous Substances – Welcome to Superfund Cloud Cuckoo Land PFAS On April 19, 2024, the EPA announced that pursuant to section 102(a) of CERCLA, it was designating PFOA and PFOS, and their salts as CERCLA hazardous substances. The rule will be effective 60 days after publication in the Federal Register. Designating PFOS and PFOA provides EPA the ability to use the full suite of CERCLA authorities – including cost recovery and enforcement. For example, EPA can now compel a PRP to take action to address PFOA and PFOS pursuant to CERCLA section 106(a). EPA said that it does not expect the number of sites on the NPL to substantially increase and downplayed impact on re-openers or five-year reviews. The gist of EPA's message is that designation will not change how Superfund works or greatly impact sites in the system. “Nothing to see here, please move along.” This designation will also provide, however, third parties with the ability to bring cost recovery and contribution actions. This litigation potential has been raising great angst and concern among the business community, municipalities and others. In response to concerns that the designation will impact so-called passive receivers, such as water systems, EPA concurrently released its PFAS Enforcement Discretion and Settlement Policy Under CERCLA. EPA says it will focus on holding responsible entities who significantly contributed to the release of PFAS into the environment. EPA says that it does not intend to pursue entities where equitable factors do not support seeking response actions or costs under CERCLA, including, but not limited to, community water systems and publicly owned treatment works, municipal separate storm sewer systems, publicly owned/operated municipal solid waste landfills, publicly owned airports and local fire departments, and farms where biosolids are applied to the land. For these same parties, EPA said it can use CERCLA statutory authorities when appropriate to enter into settlements that provide contribution protection from third party claims for matters addressed in the settlement. This policy will likely not be the magic bullet that EPA claims it will be. Many of the parties that this policy intends to help appear to be less than convinced. Currently, there are attempts in Congress to provide liability carve outs for some parties. Once the rule is effective, releases of PFOA and PFOS that meet or exceed a one pound reportable quantity within a 24-hour period to be reported to the NRC and others. Some have been predicting that CERCLA designation will be calamitous. Now that it is here, it will be interesting to see how things actually play out. #WasteWatch2024- Following the election trail, we’re stopping this week at “The Great Lakes State” of Michigan: The state of Michigan shares a coast with 4 out of the 5 great lakes, extending all the way up the state's northern peninsula. The shoreline spans Lake Superior, the largest body of freshwater in the world. While Michigan’s diverse landscape is home to rich wildlife and an array of outdoor activities, the state continues to face environmental challenges including drinking water quality related to PFAS and lead contamination, air quality, solid waste management and others. These challenges have resulted in approximately 7,300 toxic sites that require remediation. Here is what you need to know The basics: - Life expectancy - 76, 36th in the country - Population - 10.05M - Land area of 56,591.0 square miles and water area of 40,097.0 square miles - The state has over 11,000 inland lakes, over 300 rivers, 242 streams, and more freshwater shoreline than any other state. Environmental Challenges: - PFAS Contamination - Microplastics - Groundwater depletion and contamination - Algal Blooms - TCE (trichloroethylene) Recent News in Michigan, see comments for more details: - In Michigan, 1.5 million residents are exposed to drinking water contaminated with PFAS, affecting 11,300 sites across the state (Michigan State University, Dec. 2023) - During this past summer, harmful algal blooms (HABs) were found in 80 bodies of water in 38/83 counties. Breathing or consuming water with HAB toxins can result in symptoms such as vomiting, fever, and skin rashes. (WDIV-Detroit, August. 2023) - As many as half of the 300 rivers and streams and 12 beaches in Michigan are contaminated with e.coli. (Michigan State University, Sept. 2023) -Over a decade ago, state officials estimated that 10% of Michigan’s 1.3 million septic tanks failed, causing 9.4 billion gallons of untreated wastewater to flow annually into the environment.
