The Sentencing Advisory Panel (SAP) has just issued a new guideline on sentencing scam-related cases. I gave some brief remarks to The Straits Times with my take on the new guidelines. One of the trickiest things in sentencing is figuring out how to bridge the qualitative - quantitative gap. Judges and lawyers know they have to apply principles like deterrence, retribution, protection and rehabilitation, but how do these translate into a specific number of weeks' or months' imprisonment? The guidelines help a lot with this, nailing down indicative starting points for common types of offences. This helps lawyers and judges by giving them a common starting point from which to reason. This is a bigger deal than it might seem, as lawyers sometimes end up talking past each other if they don't have common premises to start with.
