DID YOU KNOW: The enforceability of the FTC's new rule was challenged in three federal courts, and each court ruled differently? In The Legal Intelligencer, Neil Schur writes, "Noncompete Law in Flux—What to Do in the Meantime?", where he looks at states that have banned noncompetes and those where legislation is still being updated. Neil identified that the FTC's rule would have banned most non-compete agreements in the workplace. It made it illegal for an employer: 🔹 To enter into or attempt to enter into a noncompete clause. 🔹 To enforce or attempt to enforce a noncompete clause (subject to the exceptions described below). 🔹 To represent that the worker is subject to a noncompete clause. It will be interesting to see how this case is resolved on appeal. But no matter the outcome, it is important that companies use a holistic legal approach to protect their competitive edge.
