SC WILL DENY 6-3 What’s inexplicable is how his Excellancy’s climate brain trust has once again recklessly put an emission reduction rule in legal jeopardy. They think they’ve covered their behinds by including EVs in IRA for apriori Congressional cover in making EVs the only way to comply. Tis an EV mandate 6 ways on any Sunday. Congressional cover meant to cure the deficiency that sank CPP1 is wishful zealot thinking. This rule will not pass SC muster, surely a 6-3 demise.

The last few months, I have been drafting motions and arguments challenging the Federal Highway Administration’s recent rule requiring States to establish declining targets for emissions from vehicles on the National Highway System. We argued that the Federal Government went behind the authority granted to it by Congress. Last night, the Northern District of Texas agreed with us. In holding that the FHWA lacked the authority to establish environmentally focused performance measures, the judge struck down the rule nationwide. This is a massive win for States to ensure that the Executive Branch stays within its bounds and acts pursuant only to the authority granted to it by Congress. And here it is - the Seattle Times Editorial Board’s predicatble support of their clients’ views on CCA. As expected, no disclosure of their financial conflicts of interest (ST is paid by environmental philanthropies to write articles in its “Climate Lab”). No mention of the financial burdens the CCA places on Washington families by inflating the cost of gasoline, natural gas and electricity, which in turn inflates the cost of everything. No mention of the fact that much of the billions in tax revenue is spent on projects that have little direct impact on the environment (massive transit spending, free tickets for kids on Amtrak, bike safety program, redundant EV charging stations). No mention that we’re only in the first phase of CCA - the taxes go up and up and up every four years until morale improves. The simple analysis is the benefit does not outweigh the burden. There are less impactful ways to continue to reduce our environmental impact. Vote yes on I-2117.

The kids are alright... and a classic chicken or the egg scenario plays out once again in court in a climate case. So a group of kids sued the state saying, we're not moving fast enough on decarbonization. State says, its personal decision by everyone to drive gas powered cars. Kids say, well we haven't created infrastructure to support alternatives. Kids win. And just sayin, I don't know about y'all but I'm guessing more than a few people would prefer to ride a bike (e-bikes are very cool) to work or walk or whatever but over so many years, the local infrastructure was built as car centric, and alternatives are just not safe nor practical. Drive and park. And swing by the gas station, the one with the lowest prices, on way. Here in TTown we have miles and miles of riverwalks all relatively new and state is replacing the bridge in center of town that crosses Black Warrior river. We could connect the riverwalks on each side of river that would open up many neighborhoods to safe pathways downtown but that wasn't in state plans for the bridge for whatever reason... probably budget(?). Anywho... ALDOT received a lot of letters and communication over that one. We'll see what shakes out. Think about it, the interstate 74 bridge over Mississippi River was recently completed with a really nice multi use path connecting the Quad Cities by something other than car or boat. I don't know why any bridge would be built today w/o that kind of consideration. But it's a good example of some forward thinking for the future.
