We have entered the age of social media influencers as a profession according to Jianming Jyu v. Ruhn Holdings Ltd as heard in the New York Supreme Court. This profession has proven extremely lucrative both for the influencer and the companies using this form of marketing. While both parties win, it is always important to record the terms of the arrangement between the influencer and the company wishing to promote its products/services on the influencer's social media platforms. Given the value of these agreements, failure by one party to perform its obligations could result in significant loss to the other. This article well describes the risks to be considered from the side of the company marketing its products/services, however, the other side of the coin is to consider the rights of the influencer. Clear agreements should always be entered into between the parties to avoid ambiguity and cater for rights of recourse. The article linked below hits on some key points: (1) Why should cities invest in social media communications? Because it is the place most people get their news. (2) While influencers are great content makers, residents are seeking a connection between the folks who are actually doing the work in their cities. We recommend training a city’s existing staff to add content creation to their daily responsibilities… it doesn’t require an inordinate amount of time and you are building your own team of authentic creators versus outsourcing influencers to do the work for you. The result - saving tax payer dollars AND being more effective in connecting with your residents. And here are the top three things you must do before hiring an influencer: 1️⃣ Verify their authenticity ↳ The majority of the engagements you see are from bots and spamming. ↳ Don’t be tricked into paying for fake followers that’ll do nothing for your business. 2️⃣ Test them out first before going heavy. ↳ Don’t just throw money at every single person with a large following. ↳ First, test their viability by paying for one to three posts and monitoring the performance. This will help you know if they’re worth what they’re asking for. 3️⃣ Are they influential in your target market? ↳ A large following doesn’t equal influence. ↳ Find out first if your ideal audience listens to this person and trusts their judgment.
