I have always argued that when local governments are slapped with punitive fines - it is not a win for the community. Because those fines, have to come out of our rates and taxes. Secondly, these are - on the face of it - sweetheart plea and sentence agreements , which is the norm insofar as environmental prosecutions are concerned. Thirdly, no single official (incl the municipal manager) is held criminally liable and fined - since there is no inquiry in terms of s34(5) or (6) of NEMA. ...and finally, despite all of the above, there is no guarantee that the Municipality will stop the pollution.

I have co-written an article for the Habitats Regulations Assessment Journal with Caroline Chapman. It relates to the use of JNCC Decision-Making Thresholds for Air Pollution, the failure of Natural England to reach a decision on their use, and the recent endorsement of the JNCC thresholds by the Office for Environmental Protection.
