Our Arbitration and Litigation partner Felipe Nazar recently attended the “ESG in Dispute: Rethinking Investor-State Arbitration in a Sustainable World” event organised by the Berkeley Journal of International Law. During the session, Felipe emphasised that “in a sustainable world, investor-state arbitration remains essential for dispute resolution, especially given the absence of a clear replacement”, and went on to highlight its neutrality and adaptability across diverse investments. AGM Abogados has launched a new practice area “ESG – Compliance and Sustainability” led by Marta Salvador Mateo and Hector Deniz Guedes. “In recent times, environmental, social and governance (ESG) issues, together with sustainability, have gained significant prominence on business agendas. Rigorous compliance with ESG principles and sustainability practices is increasingly a fundamental pillar of long-term value creation for companies,” the company said. The regulatory landscape related to sustainability and ESG at European, national, local and sectoral levels is broad and complex. AGM believes that many companies struggle to navigate this intricate regulatory framework, often unsure of their exact compliance obligations. Even if companies are aware of the relevant legislation, they say, “ensuring full compliance can be a real challenge. This lack of clarity exposes companies to the risk of unintended legal breaches or misconduct, the existence of which often goes unnoticed.
