Many people are surprised when I tell them that a bankruptcy case brings together multiple types of law: contract, secured transactions, real estate, litigation, and, yes, even family law. What's more, the relative recency of the Bankruptcy Code's adoption (the Code we use today is less than 50 years old!) allows unexplored nuances to pop up every year. In my recent article for the Minnesota Bankruptcy Bulletin, I explain a recent case by the 8th Circuit BAP which dealt with an uncommon, but not implausible, situation: what happens when an individual files chapter 7, then gets divorced, then converts to chapter 13, and then converts back to chapter 7? What status does a child-support claim (usually given first priority) have if it is post-petition but pre-conversion? And can legislative history help us answer that question? This needs to worry anyone, not just #barristers. For one thing, there is the intrusiveness of the #Bar Council’s claim. So long as the #Garrick remains a #lawful #club, and the elected #government has not chosen to force a #rule change on it, it is very hard to see what business it is of the Bar Council, or any other #professionalbody, to issue edicts." Whilst the weather hasn’t quite caught up yet, it’s time for the summer edition of #CitySolicitor magazine - the joint publication of The City of London Solicitors' Company and City of London Law Society (CLLS)! It’s a pleasure for me to hand over the editorial reins to Salome Coker, my having accepted an offer to step up to the role of Chair of the Editiorial Board. And what a great and important first edition it is for Salome, focusing on experiences of Black heritage lawyers both in the City and further afield. A plethora of excellent and incredilbly important articles, spannning: ➡️ racism within the profession, with Chair of the CLLS Colin Passmore setting the context, ➡️ the fact that just 1% - or just 90 of the 13,403 partners at major City law firms identify as Black with input from Julian Richard of extense, ➡️ how to be one of the 1% with the insight of Sandra M Wallace CBE of DLA Piper, ➡️ thoughts from Leslie Thomas KC in how we might change the dial and combat unconscious racism, ➡️ an exploration as to whether Black lawyers are treated differently to other minority groups with valuable insight from Leon Stephenson of Reed Smith LLP, ➡️ a recent study from the Legal Services Board on the impact of counter-inclusive practices on legal professionals and why ED&I can’t just be treated as a buzzword, ➡️ the cultural change needed to plug the leakage of Black talent from the profession with thanks to Raphael Mokades of Rare, and ➡️ the experience on the other side of the pond, including input from Brian Newby of Cantey Hanger LLP, one of Howard Kennedy LLP’s friends from the Meritas Law Firms Worldwide network.
