⚠️ 𝗜𝗻𝗱𝘂𝘀𝘁𝗿𝘆 𝗔𝗹𝗲𝗿𝘁 The British Columbia Construction Association (BCCA) has issued a province-wide Industry Alert following the confirmation of cases of removal of “Contract A” from the procurement process by a growing list of public owners. “Contract A” is a legal convention created in 1981 by the Supreme Court of Canada in The Queen (Ont.) v. Ron Engineering. “The Ron Engineering case was a landmark decision with regards to fair, open and transparent tendering, and the basis for the understanding of all parties having a duty of fairness to each other. After decades of working within industry and with Government on protocols and practices like CAMF to ensure that public entities act appropriately in their procurement activities, it is a travesty that Public Owners are negating “Contract A” in their documents. Public Owners must be held to a higher standard in procurement and ensure that fairness to all parties. The public interest is paramount.” - Roger Yager, P. 🏗️ MBI Town Hall Meeting Recap 🏗️ This past Thursday, Jon Hannah-Spacagna, Government Affairs Director at MBI, hosted our Town Hall meeting with Rhode Island State Building Official, James Cambio. 🌟📰 James shared exciting news about Rhode Island's progress in the modular construction industry: -The state passed legislation this year to exit the Interstate Industrialized Buildings Commission (IIBC), making it easier for the modular industry to do business in Rhode Island. -James is finalizing guidelines for the new state program, which will be based on ICC/MBI standards 1200 and 1205. Currently, the industry can utilize third-party inspection agencies for plan reviews and inspections, with the state conducting a cursory review before issuing state labels. -Rhode Island plans to adopt the 2021 International Existing Building Code, likely with some state-specific amendments. -Manufacturers are welcome to use multiple third-party agencies for inspections, removing the previous IIBC guideline limitation. -For existing structures, any relocatable structure with an IIBC label will be accepted by the state until the new program is in place. This meeting showcased significant strides in simplifying regulations and advancing the modular construction industry in Rhode Island. According to the latest construction forecast data from BCIS, building costs are set to increase by 15% over the next five years. Annual growth in the BCIS Materials Cost Index has been in negative territory for the past two quarters and is forecast to increase by a further 1% drop in 2024 with a further predicted cost increase of 14% over the next five years. Navigating the gap between tender submission and contract award can be challenging due to fluctuating costs. The BER Building Cost Index (BCI) is here to help you manage these changes effectively. Here's a quick example: A contractor submits a tender in March 2021 when the BCI is 105. By June 2022, the contract is awarded, and the BCI has risen to 112.4. According to the BCCA, 44 Public Sector Owners in BC have recently attempted to avoid the Contract "A"/ Contract "B" framework created by The Queen (Ont.) v. Ron Engineering, [1981] 1 SCR 111 when tendering projects. While the legal veracity of these attempts remains untested by the courts, they create business risks for bidders by weakening procedural fairness. For example, an owner could bid-shop between companies. In turn, the removal of Contract "A" suggests that companies are not bound to their bids or even the tender call's stated terms. In short, this trend re-introduces the chaos that Ron Engineering attempted to remove from the tender process. Helmets on, folks.
⚠️ 𝗜𝗻𝗱𝘂𝘀𝘁𝗿𝘆 𝗔𝗹𝗲𝗿𝘁 In the opinion of the British Columbia Construction Association (BCCA) , the removal of “Contract A” is the most significant violation of public sector procurement processes that the construction industry has seen to date. BCCA has issued a province-wide Industry Alert following the confirmation of cases of removal of “Contract A” from the procurement process by a growing list of public owners.
