Justices on the Illinois courts of review do not typically disclose the reason for recusal. They should. In three recent cases, two of which have a heavy political valence, justices of the Illinois Supreme Court and Illinois Appellate Court recused without any statement as the reason. Indeed in one of the cases, we do not even know which justices recused. That should change. There is no suggestion of impropriety, only that disclosure is proper so that the People can evaluate the reasons for recusals and also whether other justices should have recused. The Illinois Supreme Court Rules Committee heard public comments on a number of important, including Proposal 23-05 that would impose a who range of duties on lawyers to report the mental disability of lawyers and judges well beyond that which is currently required or required in any state. The Republican candidate has dedicated himself to reducing domestic violence as a prosecutor and a judge. His ability to think about the justice system as a whole fits with the role of an appellate court judge. The Democratic challenger, Velda Renita Faulkner, has practiced law for decades but does not seem prepared to take on this role."

Putting aside the politics, those of us who frequently litigate in the federal courts know firsthand that the numbers of cases filed in federal court have continually grown over the past few years. As noted in this Law360 article, "caseload analysis shows district court filings have grown by 30 percent since 1990, when the last comprehensive judgeship bill was enacted," … "Increased caseloads lead to significant delays in the consideration of cases and increased expenses for civil litigants and constitute a harmful effect on citizen access to justice." However, the problem is solved, it does need to be solved in an effective, efficient, and non-partisan way. The Justice Department appealed to the Supreme Court to enforce revisions against twenty-six opposing states. The Court ruled that the Government lacked sufficient grounds to overturn lower court findings. "I cannot fill all the calendars that we have, and that means that it has a pretty significant impact on how we process cases and how we deliver justice to the citizens of the District of Columbia. I don't have enough to make the court function." -- DC Superior Court Chief Judge Milton C. Lee Jr. Did you miss the below post last Friday? Nine DC-area bar associations and non-profits banded together to urge the Senate to schedule votes for pending DC judicial nominees. Because of the continued denial of statehood to DC, if these candidates are not voted on by the end of this Congressional term, they will likely be abandoned. DC representatives cannot nominate or appoint judges for our own local courts because we are not a state. The President must nominate judicial candidates and the Senate must approve them. Our courts are woefully understaffed right now, as noted in a recent article (linked in the comments), resulting in DC residents facing severe delays in everything from family court issues to criminal cases and business litigation. The Senate must act quickly to schedule votes on all pending DC judicial nominees to ensure justice for DC residents. This week, we proudly joined the Washington Council Of Lawyers and seven other bar associations in urging the Senate to act. Eight nominees for DC Superior Court and the DC Court of Appeals have been awaiting a vote for months. Because DC is not a state, only the President can nominate judges, and the Senate must confirm them. If these votes don’t happen before the session ends, the process restarts. DC residents face severe delays in cases from family court to business disputes. We urge the Senate to confirm these nominees now. #DCStatehood #AccessToJustice #courts
