Medical Marijuana companies are not covered entities and therefore, are spared from HIPAA compliance requirements....for now. However, the point about data security across all operators, adult use and medical alike, is a good one. Cannabis companies collect lots of consumer data, much of which is sensitive data like names, birthdates, address which does heighten the risk of cyber threats. Operators should be prioritizing data privacy compliance, allowing them to more easily adapt to the evolving landscape. #CannabisIndustry #HIPAA #DataPrivacy #Cybersecurity #HealthCareLaw

Arkansas medical marijuana sales show an interesting trend: pounds sold through November surged by nearly 23%, reaching 68,877 pounds, yet sales revenue dipped slightly by 2.1%, totaling $251.9 million. Arkansas medical marijuana sales reached $227.8M through October 2024, a 2.65% decrease compared to 2023. However, total pounds sold increased by 23.2%, reflecting reduced product prices. Suite 443 in Hot Springs and Natural Relief in Sherwood were among the top-performing dispensaries. With over 106,000 active patient cards statewide, the market remains strong, but surpassing 2023’s $283M sales record will depend on November and December performance. The Health Insurance Portability and Accountability Act of 1996 (#HIPAA) is a #federal #law that required the creation of #national #standards to #protect sensitive #patient #health #information from being #disclosed without the patient's #consent or #knowledge. The US Department of Health and Human Services (#HHS) issued the HIPAA Privacy Rule to #implement the #requirements of HIPAA. The HIPAA Security Rule #protects a #subset of #information covered by the Privacy Rule.

Medical Marijuana in Alabama is Limited - Alabama has a limited medical marijuana industry, which allows for high-CBD/low-THC cannabis to be provided for medical patients with a prescription. To attain a prescription, a physician must have recommended medical marijuana based upon a state-qualifying condition. If you are in possession of medical marijuana legally, upon testing, if the THC amount is higher than the legal threshold, you may still be charged with marijuana possession. If you are caught in possession of marijuana, whether medical or recreational, you may be arrested even while testing of the substance is pending. NEW; The Massachusetts CCC announced today that they will attempt to expand the per-entity license cap in the state, by allowing someone to own up to six delivery licenses (3 courier licenses and 3 delivery operator licenses). MGL Chapter94G (16) may allow this change, but it seems very controversial; The law reads; "No licensee shall be granted more than 3 marijuana retailer licenses, 3 medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses or 3 marijuana cultivator licenses; provided, however, that a licensee may hold 3 marijuana retailer licenses, 3 medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses and 3 marijuana cultivator licenses." While that does not include delivery licenses, this new change as proposed by the CCC would allow, as mentioned, a single entity to own/control 6 delivery licenses (in total). It will be interesting to see how lawmakers react to this proposal. The regulations the CCC are discussion today are only in an initial draft form, and will go out for public comment shortly.
