The recent NAR Settlement has officially taken effect. Here are two key provisions of the settlement to be knowledgeable of: ✅ The MLS will no longer be a platform for communicating compensation offers. ✅ Buyer-broker agreements are now required. The dust is starting to settle for lenders in the post-NAR Settlement world: ✅ FHA (FHFA) ✅ Conventional (Fannie and Freddie) ❓ VA - this is the big one we're all waiting for clarity. Surely the VA can't leave vets out to dry, right? RIGHT?! To be clear, the GSEs have only clarified that nothing is changing in their interpretation of how agent commissions are NOT considered IPCs (for those not familiar with the jargon, that's a good thing). But as of now, it appears that vets utilizing their VA loan may be in a sticky situation. The VA's current guideline is pretty clear that vets can't pay their agent's commission if they utilize the VA loan to purchase a home. The VA's intent of this guideline was in the right place - preventing vets from incurring additional financial burden. Everything works great if the seller pays the buyer's agent (even though they don't have to). But in this post-NAR settlement world it's clear that vets could now be at a significant disadvantage if they can't afford to pay their buyer's agent commission, while planning to utilize their VA benefits. The good news is that there's still time for the VA to make a change and provide clarity (pending the actual settlement being approved too). Having used the VA loan myself, I can tell you it is a MASSIVE benefit that helps vets get into a home - especially first-time homebuyers. I realize some people may call this being an alarmist, but yeah, it's time to sound the alarm and make sure vets aren't left out to dry.
