Procurement professionals often fear 'legal challenges' from unsuccessful bidders, and it can have a large negative impact on them as individuals. This is not to say that legal challenge isn't required in certain circumstances. However, (and it boils my blood to say it) think of it this way: If a Bid Lead, often someone very senior in sales, spends 18 months working on a bid, spends over £1m in 'bid budget', pulls resources from all over the company to work on the submission...and then loses, this often doesn't reflect well on the individual. When many firms target a tender 'win ratio' of 1 in 3, many sales careers have been made or negatively impacted by the result of a bid. It's very easy in this instance to then suggest the process 'wasn't fair'. After all, what's another £20k in legal fees to throw in a challenge after blowing £1m on a bid. This is especially powerful if the company that issued the tender then chooses to settle rather than go to court, and the bidding company can recoup lost bid costs. This is one of the reasons why Stakeholder engagement, management, and relationship building are critical for any procurement function, so that everyone involved in the process, from pre-market engagement all the way through to tender result, is on the same page and not opening the company up to unnecessary risk. #procurement #stakeholdermanagement
