Independence Day is celebrated annually on 15 August as a public holiday commemorating the nation's independence from the United Kingdom on 15 August 1947, the day when the provisions of the Indian Independence Act, which transferred legislative sovereignty to the Indian Constituent Assembly, came into effect. Independence coincided with the partition of India, in which British India was divided into the Dominions of India and Pakistan; the partition was accompanied by violent riots, mass casualties, and the displacement of nearly 15 million people due to religious violence. "The British imposed a unified administration on an area they called India. When they left, we thought we’d continue the colonial experiment, but we called it a democracy.” Said the economist Ashok Mitra. The contradictions that make up India are legendary, but Mitra’s comment is more radical than that – it points to the fragility of democracy in this nation. Is democracy fragile in India? Even as we face questions about the procedural propriety of local and national elections, the bigger danger seems to be the inseparability of democracy and majoritarian populism that holds the state to ransom. Four days before the 74th anniversary of India’s constitutional declaration of itself as a sovereign, secular, socialist state, the state harnessed its administrative, media, and popular force to celebrate the inauguration of a temple for the mythic hero of a religious epic. Where this leaves minority rights on the planes of symbol and practice is not a question that is traceable anywhere on the horizon. But of course this is not the eruption of a day; nor is this without a tumultuous history of its own. Debilitating factionalisms in linguistic, regional, social and communal identities have strained the reality of nationhood throughout the history of India’s postcolonial formation through the violent partition of a subcontinent. The date July 4th, 1947, is quite the historic date in India’s walk towards Independence. The Act was more than just a legal document; it embodied the struggles of the Indian Freedom Movement, and the intricacies of a pluralistic state for sovereignty and partition. The Last Viceroy of India, Lord Mountbatten, was tasked with supervising the transfer of power from British rule to India. He, along with the British Prime Minister, Clement Attlee, devised a plan to divide the British Indian colonies into India and Pakistan after consulting with the Indian National Congress, the Muslim League, and representatives of the Sikh community on on June 3, 1947. The Indian Independence Act 1947 proposed the partition of British India into two the dominions of India and Pakistan and granted full legislative authority to both dominions, with the power to frame their own constitutions and governance structures. See the concluding part of the Simon Commission Report. Due to 100% reservation based futile legal enactments, all the issues happened in India. The concept of impartial justice, laws from hearts, the rules to ensure prevention of miscarriage of justice, equal civil and civic Rights without reference to caste or creed is yet to be reality in India. Nehru never read the Simon Commission Report and boycotted the same and crooked stories of history diverted all and nobody knows the exact history of India. Please download the Simon Commission Report and see the caring words and hoping for the best through mutual respect and impartial analysis and the final deliverance of impartial justice, that is yet to be implemented in India.
