National Victim Rights Advocate | Member, U.S. Congressional Crime Survivors and Justice Caucus Advisory Committee | Governor's Courage Award
From National Center for State Courts: Finding: All too often, the criminal system is a path of first instead of last resort to access care. A continuum of behavioral health programs, services, and alternatives must be available in the community to prevent individuals with mental illness from entering the criminal justice system, and when appropriate, if criminal justice involvement occurs, deflect and divert to treatment and care as soon as possible. Recommendation: This continuum of care in communities must include a robust set of services and deflection and diversion opportunities that meet the needs of individuals with behavioral health disorders whether through the behavioral health system, the behavioral health crisis system, pre-arrest deflection and diversion, pre-adjudication diversion, or post-adjudication diversion. All judges should exercise leadership to expand and improve responses to individuals with mental illness across the continuum of behavioral health diversion. The Judges’ Guide to Mental Health Diversion provides a roadmap for judges.
Judges play a key role in diversion programs. To help, we recently released the Judges' Guide to #MentalHealth Diversion, which empowers judges to utilize jail diversion tactics post-arrest and pre-plea. https://bit.ly/3RqB3O8
