How can employers legally conduct criminal checks: ✅ Legal Framework for Criminal Checks: The practice of conducting criminal checks on potential employees is governed by several pieces of legislation, including: (1) The Constitution of the Republic of South Africa (2) The Protection of Personal Information Act (POPIA) (3) The Employment Equity Act (EEA): ❓ When Can Employers Conduct Criminal Checks? (1) Relevance to the Job: The criminal check must be directly related to the job requirements. (2) Consent: Employers must obtain explicit, informed consent from the candidate before conducting a criminal background check.
