Application of Laws The Sales of Goods Act (SOGA) 1979 and the Unfair Contract Terms Act (UCTA) 1977 explore the conditions for breach of contract and contract frustration by either the seller or buyer. Part II of the SOGA ensures that the product is sold in quality condition to meet the intended purpose (CACJ, 2024). However, the air purifier sold to Mobile Medical Group by Lim’s company did not meet the quality standards. For example, the product did not meet the required air specifications and battery life, as defined in the sales receipt. It failed to meet the 12-hour operation with adequate air quality. As per the SOGA 1979, Lim’s company was in breach of contract for selling below-quality products that did not meet the specified abilities. SOCA states that “the seller must ensure the product is of satisfactory quality and reasonably fit for purpose,” contrary to the condition of the air purifier sold to the Mobile Medical Group (CACJ, 2024). Therefore, the buyer has legal backing to claim a breach of contract by Lim's company.

Can a Risk of transport damage to a consignment of childres toys imply that the entire consignment must be deemeed a total loss ? In many cases, a question arise as to whether a possible risk that a shipment has been damaged during transport should be considered to imply that the entire shipment must be deemed a totall loss, or whether the goods, regardless of such risk of damage, can be marketed. The Maritime and Commercial Court has in some decisions decided that a risk that the consignment of goods may be affected can be sufficient to consider it a total loss, even though there has been no expert assessment on the matter. In these cases, transport has involved pharmaceutical products, foodstuffs, and electronic goods, and the cases have, among other things, focused on the regulatory requirements applicable to the sale of the products concerned regarding hygiene, safety, etc., but also on the degree of (risk of) physical damage and the costs of conducting investigations and remediation of potential damages. The Maritime and Commercial Court has in a recent judgment decided a case where these issues arose with regard to a transport of childrens toys. https://lnkd.in/dBTJsP-9
