Important for spicejet not to go under Spicejet had been in the news for all the wrong reasons for a long time now. For those in the aviation industry it is easy to read the writing on the wall. This airline is in danger of going under. Cancelled fights, curtailed schedule and dwindling fleet all point to this. Further the salaries are being delayed , ppf not deposited and I am sure tax deducted from salaries would also not be deposited. We have seen a similar pattern before in case of Kingfisher, Jetairways and Goair before they wound up. Employees are the worst hit but the shock waves are felt in the whole industry. It is not only the employees who get laid off but it also upset the dynamics of the whole industry by putting 1000s of qualified people in the market. The demand and supply curve which is already lopsided becomes even worse and it takes several years to recover from it. For passengers it is extremely bad news as they are left in the duopoly market. It appears now that it is not an internal matter of spicejet any more. With every passing day it would become more and more difficult for spicejet to dig itself out of the hole they have dug up for themselves. The GOI which includes DGCA and the ministry of finance needs to step in to mitigate and protect the interests of employees. They need to make sure the dues of employees are cleared and ppf and IT is deposited. This has to be done even if it puts more burden on the struggling airline. By doing so if it hastens the exit of the airline then so be it. The government owes it to the employees. Fingers crossed that spice can somehow manage to pull through though appears very unlikely. #spicejet #airlines #dgca #moca #passengers

This LMAA award summary highlights critical issues for those handling performance claims. This decision reinforces my previous observations in the article published in I-LAW, "Reflections on Speed and Performance Claims" (2023). The summary is thorough, providing an in-depth explanation of several points that will be valuable to the reader. For those attending the LMAA Seminar on October 3, I would be happy to meet with you. ----------------- Does the weather routing company (WRC) report meet the minimum data standards required for London arbitration? Those familiar with the applied methodologies will easily identify at least one WRC involved here and recognize that many companies still fail to meet these standards. All weather vs good weather analysis: If a ship performs in all weather but not in good weather ( sometimes it happens in practice), there is no claim. WRCs continue to overlook this fundamental point and repeatedly argue otherwise during negotiations. As the tribunal noted, “As the charterers suffered no financial loss under either scenario, they should not have pursued a claim against the owners for underperformance.” Had Charterers sought an independent opinion ( as they should) they would have been advised otherwise. Deck logs vs weather routing analysis: As always, evidence must be fitted with and tested against the other evidence. In this case, the deck logs prevailed. The tribunal made several observations about the AIS. What if Charterers instruct a routing company excluded from the contract? The tribunal made a clear distinction: the arbitrator accepted the weather data but rejected the conclusions. It also stressed that WRC report does not meet the criteria of an “expert report”. Submitting two performance reports can complicate matters further. Differences between LSDO on delivery and redelivery: While minor differences are possible (trim, temperatures etc), if Charterers haven’t paid for or supplied LSDO, they cannot show more bunkers on redelivery and deduct sums from hire. This is a logical conclusion and one I have often debated in practice. I think this is the first award clarifying this point. In conclusion, Charterers should have sought an independent opinion rather than relying solely on their appointed WRC (producing different “enhanced reports” due to clear mistakes). It's unfortunate that arbitration arose over a $10,000 claim that could have been resolved through proper discussion.

Another UK collective action settlement has been announced 📢 Coming hot on the heels of the settlement between Mark McLaren and Compania Sud Americana De Vapores S.A. late last year, could this signify the beginning of a change in Defendants' attitudes to class actions in the UK? … 🤞 In this latest development, Class Representative, Justin Gutmann, and Stagecoach South Western Trains Limited, have reached partial settlement related to the Boundary Fares Claim before the Competition Appeal Tribunal. The claim alleges that certain train operators have not made 'boundary fares' readily available for Travelcard holders to purchase. The partial settlement, reached without admission of liability, sees Stagecoach South Western Trains Limited agreeing to pay up to £25M to eligible class members. If the settlement is approved at a hearing due to take place at end of the month, it will represent the largest class action settlement in the UK to date and will be a significant step forward in demonstrating how the regime can facilitate large scale redress. #CasePilots #Litigationsupport #classactions
