A federal appeals court cleared the way Monday for San Francisco to sweep homeless encampments, in the wake of last month’s Supreme Court ruling, as long as it allows residents to recover their personal property.

I get the frustration over #homeless camps, and Sacramento has a huge problem with this, AND it's a major public safety problem for all involved; I just wonder if the DA is dealing with the violations directly? If there is shelter available, even the #Boise or #GrantsPass cases out of the 9th Circuit don't restrict enforcement of the law. This is a significant change in public safety enforcement, particularly concerning issues like public property, homelessness. A more aggressive approach in removing homeless individuals from public property will force them to go elsewhere. The shift will lead individuals towards private sector and business properties more frequently, presenting challenges in removal as many are resistant to services. While a positive step, much work lies ahead. Today is a big day. The Supreme Court is starting a case called Johnson vs Grant's Pass. A case that many of my colleagues will be following with bated breath. The case revolves around the 8th amendment "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted" and the legality of being human, and whether a government (city/state/federal) has the authority to impose civil fines for conditions inherent to houselessness, and consequently de facto criminal charges (unpaid fines for sleeping on the sidewalk = warrants and jail time). Inform yourself on the issue, and contact your government officials to let them know where you stand, since they only care about what we care about. Hopefully the U.S. Supreme Court will rule in favor of Grants Pass’ (OR) appeal regarding the ability of Grants Pass to enact ordinances and laws that would regulate the ability of the homeless to camp in public. Since the Martin v. Boise decision, we have seen the growth of homelessness and homeless encampments go nearly unchecked, along with the associated crime and health problems, with little authorities could do to regulate or abate the problem. Decisions such as Martin and the 9th Circuits recent blocking of San Francisco’s anti-camping ordinance have made it extremely difficult to clear encampments, provide services to the homeless due to the unruliness of the camps and their atmosphere of lawlessness, and created opportunities for costly (and often frivolous) lawsuits against our local governments therefore depriving the communities of funds they could have spent else where (like homeless outreach programs). A good article from Clare Pastore reviewing the #SupremeCourt ruling in #GrantsPassvJohnson--a horrific, disgusting decision that ignores both the facts and legal precedent. It's a terrible loss that makes legal challenges to the criminilazation of homelessness proliferating across the country that much harder. But the case has also spurred tremendous organizing, building the coalition for #HousingNotHandcuffs. Housing is the most basic of our rights in America…yet Local governments criminalize homelessness by making it illegal for people to sit, sleep, or rest in public spaces. Almost every state has at least one law that bans activities people experiencing homelessness engage in simply to survive. Laws that prohibit panhandling, loitering, living in vehicles, or sharing food and water in public spaces all discriminate against people experiencing homelessness, as authorities eject them from public spaces, confiscate and destroy their property, and transport them to mass shelters and jails. These practices threaten their health and well-being and, ultimately, their lives.
