Good info in this article. But they miss the chance to talk about the more common and cumbersome way people inherit property; intestate or “heirs property”. Heirs roperty presents its own sets of challenges and limitations when deciding what to do with the property. There is a lot of work needed to untangle the issues presented by generations of passing property without wills or deeds.

🚨 Relationship Status: It’s Complicated 🚨 In my practice, I've been seeing more and more property disputes between non-married couples. You know, the classic "who gets the couch" dilemma, but with a twist. Recently, the Minnesota Supreme Court threw a curveball in the case of David Carl Hepfl vs. Jodine Patrice Meadowcroft. Spoiler alert: Hepfl gets compensated for building a cabin on Meadowcroft’s land. 🏡💸 Why is this case a big deal? Well, generally, title determines ownership of property. However, improvements to property may be a different story. Hepfl and Meadowcroft had a saga worthy of a soap opera—two marriages, two divorces, and a cabin built during a reconciliation. Hepfl financed the cabin, dock, and even an outhouse (yes, an outhouse 🚽). When things went south, he wanted his money back. The court agreed, ruling that Meadowcroft would be unjustly enriched if she kept the cabin without paying Hepfl $56,633. The Minnesota Supreme Court clarified that unjust enrichment doesn’t require the other party to be a villain. It’s about fairness, folks. Ultimately it is about the "intent" of the parties when the improvement occurred. The Court determined that Hepfl didn’t intend his cabin-building spree as a gift, and the court backed him up. Instead, it was a joint investment. Moral of the story? Mixing finances with your significant other can get messy. Consider a Cohabitation Agreement to sort out property and financial matters before things get complicated.
