It is extremely disappointing to see there be no meaningful legislative discourse about the decision to re-criminalize psychedelics in Oregon. It is baffling from a social justice point of view, particularly because the consumer-driven Measure 109 marketplace is starting to take off, now with 7 licensed psilocybin manufacturers and 20 licensed service centers, and the cheapest cost of access being around $1,000. Who does re-criminalizing psilocybin and other psychedelics actually help? Re-criminalizing psychedelics, and psilocybin in particular, was more of an oversight than a decision. An oversight made under a lot of pressure to avoid a ballot measure that was being threatened, which was believed to be much more painful than where HB 4002 landed. This article speaks to the situation with nuance and insight.

Where does the support for psychedelic ballot initiatives lie? 👉Voter-initiated efforts in Oregon, Washington DC and Colorado successfully passed major decriminalization and legalization (of facilitated use) laws in 2020, 2021 and 2022. 👉California saw two new psychedelic-related ballot initiative campaigns emerge in 2023: -The ballot initiative put forward by Decriminalize California seeks to legalize and regulate the therapeutic use of psilocybin. -The other ballot measure is focused on creating an agency, named the TREAT Institute, in California that would be equipped with $5 billion to fund research and drug development activity around psychedelics. Both initiatives are collecting signatures, which will determine whether they make it to this year's ballot. 👉A Massachusetts-based group began campaigning for the inclusion of a question on the state’s 2024 ballot focused on the legalization of plant-based psychedelics. The proposed law would allow for the legal consumption of psychedelics at regulated therapy centers in the states and decriminalize the possession of many psychedelics.
