Dear Legal Professionals, Request for your opinion on below points ( letter attached containing these conditions) When ICICI Bank offers employment to an individual, it includes two terms and conditions in the offer letter for which the employee's consent is sought: 1- Joining Competitor: In case of termination by the bank or resignation by the employee, the employee agrees not to join any banking or financial services company for six months from the date of resignation/termination. 2 -Non-Solicitation: During employment with the bank or after cessation of employment for any reason, the employee agrees not to solicit or induce any employees/business associates of the bank or its group companies/partners to leave their current employment and join a competitor for six months from the date of cessation. However, it has come to light that the bank is not adhering to these policies when employees leave and immediately join competitor banks. Instead of taking appropriate action against such employees, the previous employer,ICICI Bank,provides positive verification reports to the new competitor bank. This raises the question: Why does the bank include these conditions and seek consent from employees in the appointment letter if it does not follow them itself ? Additionally, if the bank mandates consent from employees during the job offer, why does it not adhere to these rules ? The breach of these policies raises concerns about legality. Is the violation of these policies illegal or not ? The policies that suit the bank's interests are strictly followed, while those that do not suit its interests are violated.
