All great points! Merch has always struck me as a “walking billboard,” or a mobile form of word-of-mouth marketing. Every piece promotes the brand and also signals alignment with the values or communities the people who wear it represent. Merch can turn consumers into brand ambassadors by blending loyalty with organic visibility, making it one of the most effective forms of strategic, modern marketing in my eyes. I’ve always thought (especially in markets that heavily limit marketing) that brands should offer merch at cost or even a slight loss, and view it as a marketing cost that pays dividends over the long run rather than charging large markups. Especially to loyal consumers at the least!

The other day, my mum told me about a makeup brand she found online. She loved the product but felt unsure about buying it without trying it first. At first, it seemed the brand was only available online. But a quick Google search showed it was sold in several physical stores, including big ones like Sephora. When I told her, she said: "The website should show this." And she was right. Even though "Where to Buy" pages aren’t a new strategy, that’s when I realized just how essential they are. So, if you run an online business and your products are sold in retail stores, create and prioritize a "Where to Buy" or "Store Locations" page and optimize it for organic search. Navigating the marketing minefield – trade mark blow-ups in gift card ads and lotteries! 💳 Well-known brands are particularly vulnerable to exploitation in gift card ads and lotteries. For example: “Play online roulette to win a 10,000 EUR CHANEL gift card.” Problematic? Or how about a coffee shop offering a chance to win a FINNKINO gift card? Acceptable? 💳 A recent seminar (IPR University Center) covered a case on referential use, where third-party services offered a chance to win a ZARA gift card. The key issue was whether the trade mark holder could prevent this use, claiming infringement. The ad featured the gift card as well as ZARA logo, with no business relationship between the parties involved. In a decision (C-361/22), the European Court of Justice addressed the question. In brief, it had to be determined whether the use of the ZARA-logo was necessary to indicate the intended purpose of the service. A similar issue was addressed in the earlier Gillette case (C-228/03) in relation to goods, where it was ultimately ruled by the Finnish Supreme Court acceptable to use a sticker on packaging stating that Gillette handles were compatible with the blade. However, in the ZARA case, the national court (Spain) ultimately found that the use illustrated in a gift card ad was not necessary. The court also assessed whether the use adhered to honest commercial practices and concluded that the ad involved an unlawful transfer of ZARA’s trade mark image and the exploitation of its reputed character. So – to avoid legal pitfalls ➡️ ensure that any use of a trade mark in promotions is necessary to indicate the good’s or service’s purpose and complies with honest commercial practices. Always be transparent and avoid implying any problematic endorsement or affiliation with a well-known brand or its reputed character unless authorised. #marketing #trademark #brand
