Outline planning permission granted for 120 dwellings at Ashfield Farm in Desford... An application for 120 dwellings on land at Ashfield Farm, Kirkby Road, Desford was refused by Hinkley and Boswell Council for several reasons - the effect of the proposal on highway safety and the local road network; the living conditions of neighbouring occupiers with regard to noise; the effect of the proposal on the character and appearance of the area; and in the planning balance whether any harm would significantly and demonstrably outweigh the benefits of the scheme.   In allowing the appeal and granting planning permission, that a condition requiring a ‘Grampian style’ condition regarding the delivery of a 2m footway was acceptable for highways safety and that “there are material considerations to warrant a decision other than in accordance with the development plan.”   The appeal decision is attached.

Easements - asking for a friend ;) There is a stormwater easement, benefiting Neighbour A, over the land of Neighbour B. Neighbour A lodges a Development Application with their local Council. This DA relies on the use of their stormwater easement over Neighbour B as a legal point of discharge. Neighbour B has filled in the swale that was built in the easement and built fences across, therefore the easement does not function adequately anymore. Because of this, Council won't approve the DA. Instead, they insist on the construction of a pit and pipe network through this easement, to capture all flows up to 1% AEP since overland flow does not work anymore. Council also requires owners consent from Neighbour B to let Neighbour A do these works. Neighbour B refuses to provide owners consent and refuses to reinstate the easement the way it was built originally. Where does this leave Neighbour A? What are the responsibilities of Council in this situation? I'd love to hear your opinion if you have experience with these types of issues.

🌊 Water Industry News: Contract Agreement with Thames Water 🌊 Barhale has secured a £14.8 million contract with Thames Water to rehabilitate sections of the historic New River, one of London’s oldest water infrastructure assets. What you need to know: 🎯 This vital project will target areas in Hornsey and Waltham Cross to prevent leakage and extend the waterway's lifespan. 💪 They will be using a state-of-the-art Giken sheet piling system to strengthen the northern side of the waterway, minimizing noise and disturbance for the community. 🔎 Their innovative approach includes deploying pontoon barges for equipment access and silt excavation, ensuring they navigate the New River's constrained path efficiently. ⚒ At Waltham Cross, they will install sheet piling along a 1.1km stretch, reaching the impermeable London Clay to prevent water leakage. The gap between new and old piles will be filled with pea gravel for added stability. 🌍 Additionally, they are taking significant measures to protect the local ecology, including the use of a bubble curtain to prevent silt debris dispersal and to discourage fauna from approaching the works. 🤝 Barhale continues its relationship with Thames Water to collaborate on this essential refurbishment project, ensuring the longevity and efficiency of this historic waterway. We are now using the MuckStopper gulley and manhole protection units on a couple of new developments, which will hopefully reduce the volume of excess silt and debris in the new sewers that we install. The theory is to invest now and reduce jetting and cleaning visits at a later date, but only time will tell if this has been successful in reducing our costs. However, cost saving or not, we are also doing our bit for the environment by reducing the amount of silt and waste that is entering the sewer system.
