Today (10/1/24) marks the first milestone of Connecticut’s latest targeted #PFAS phase out law. Effective today, no person shall use, sell or offer for sale as a soil amendment any #biosolids or wastewater sludge that contain PFAS. Although the use of biosolids in Connecticut by farmers as a cost-effective fertilizer is not extensive, PFAS contamination from biosolids has raised significant and more widespread concerns in other states (e.g., Maine), resulting in the closure of multiple farms across the country. Looking ahead, the same law (PA 24-59) eventually will require notices/labels/disclosure for products in certain key industries in 2026 before a full ban on intentionally added PFAS in those industries in 2028.

Despite all the technological improvements and increased regulations, pesticide application is not always perfect. Pesticide drift, aka off-target application, aka chemical trespass, resulting in crop damage and yield loss continues to create claims and litigation between neighbors. In many cases, proving whether a chemical trespass may be straightforward. However, proving economic losses are generally more difficult and may encompass losses that extend beyond the crop year. Pesticide manufacturers and registrants, like many other companies, are facing increased pressure to remove per- and polyfluoroalkyl substances (PFAS) from their products. This pressure, however, is often focused on how the substances are defined as a class, rather than how science has measured the toxicity of each specific substance within it. This is particularly troubling with respect to PFAS because most of the substances in the class lack any scientific evidence of an ability to harm humans, animals or the environment.
