Have you been unfairly dismissed? Unfortunately, unfair dismissal cannot be considered a rarity in South Africa. An unfair dismissal affects a person’s livelihood and trust in the workforce and often leaves an employee feeling hopeless about what they can and should do in such a situation. A dismissal is considered automatically unfair if an employer acts contrary to Section 187, read with Section 5 of the Labour Relations Act, which focuses on the protection of employees and applicants, respectively when it comes to unfair dismissals.
