An example of how USCIS is not on your side: In an EB-1A, when you meet the minimum three criteria, that’s a good thing, right?🤔 But, get this. ✳️ If USCIS thinks you meet the minimim three criteria, but thinks you don’t pass the final merits second step, they have a policy to issue a Notice of Intent to Deny (NOID) instead of an RFE. 😱 Apart from having a super scary name, the other downside to a NOID is that you only get 33 days to respond, versus the typical 90 day deadline for an RFE. So, congrats, you meet the minimum three criteria. Here’s a NOID. 🤦♀️ But: I would argue that a NOID here is not necessarily bad news. ✅ The silver lining: 1. When you respond to a NOID, you have the opportunity to win more criteria, further strengthening final merits. In most cases we have seen, they have poorly conceived arguments for not wanting to award you criteria you deserve. We have had a lot of sucesss winning more criteria at this step. 2. The NOID gives you the opportunity to force them to narrow their focus on your impactful narrative. They have no choice but to read over and over again why you are generally awesome. 3. And hey, you got the minimum three criteria right off the bat! 💡 The NOID is not as scary as it sounds. At the end of the day, the EB-1A is all about final merits. But final merits is not just some section you tack on to the back of the petition. 🚀 It’s the FIRST IMPRESSION you create from the get-go, and begins with the type of evidence you accumulate while profile-building.
