I love this article by Rob Chesnut about the need for a strong culture of ethics and integrity. While his focus is on speak-up culture and use of hotlines, it applies more broadly to the decisions people make in their day-to-day work, which can increase or reduce the risk your business faces. In this latest article of Bloomberg Law, Rob Chesnut says companies have no reason to fear potential #whistleblowers if they cultivate a #culture where employees believe the company will do the right thing. He has talked to many whistleblowers and noted that "they aren’t drawn to report by a desire to get rich. They feel ignored by an internal culture that won’t take their concerns seriously and are compelled to act by a deep sense of what’s right, even knowing the step they’re taking could be disastrous to their career." He further says, “Yes, I’m sure you’ve got a #compliance program. It’s probably great. But now, more than ever, that’s not good enough. You also need an #integrity program.” This is an interesting argument. Many organizations consider whistleblowers as snitches rather than as individuals willing to come forward for the genuine good. I know organizations still consider compliance programs as protections against unwanted practices, but there is very little discussion about an internal culture that promotes integrity, where employees feel comfortable speaking up and confident their concerns will be investigated and addressed. Rob’s book "Intentional Integrity" is one of my favourite books, which I used as a mentor in absentia. I agree with what Rob says: with compliance, more than ever, you also need an integrity program. Leading Integrity This post explores the connection between integrity, accountability, whistleblower retaliation and productivity. When those engaged in organisational wrongdoing misappropriate organisational resources to conceal and cover-up their wrongdoing, staff notice it. When those wrongdoers destroy the hero of integrity who has exposed their wrongdoing, staff notice it. When staff are kept in the dark, gaslit, and subject to accusations when they raise legitimate concerns, other staff notice it. When those destroyed by organisational wrongdoers seek justice, and the court does nothing about, say, the admitted destruction of evidence, by the wrongdoers, staff notice it. When only 3% of legal cases uphold the claim of the whistleblower, staff notice it. When 85% of whistleblowers suffer career, income, reputational and mental health destruction, and the courts offer no redress, staff notice it. Another group notices everything that staff notice: potential wrongdoers. They are emboldened by the discovery of their impunity. When staff see case after case of organisational abuse of heroes of integrity, (whistleblowers), everyday in the media, staff notice that justice and integrity have left the building. What impact does that have on morale, and trust? A profoundly negative impact. If staff can't trust the people they work for, how productive will they be? Not very. If wrongdoers know that they can engage in the deliberate destruction of rightdoers, rather than add value, how productive are they being? Not very. In the UK, people of integrity, whistleblowers, are destroyed by wrongdoers and left high and dry by the regulatory bodies, (to whom they reported the wrongdoing), then they are further damaged by the legal system. If you knew, that by doing the right thing, (try to stop the wrongdoing), that you would be destroyed, with no chance of legal redress, would you speak-up or keep quiet? Your entirely rational answer is why we have such high corruption and low productivity in the UK. This toxic truth reduces staff morale and productivity. The toxic wrongdoers are so busy concealing, covering-up and retaliating, that their productivity is also reduced. How do we address the integrity deficit that is causing the productivity problem? We won't until we 1. Introduce personal liability and accountability (of those who misappropriate organisational funds to conceal and cover-up their own wrongdoing), and 2. Introduce proper protections for rightdoers. Until then, the UK's productivity will continue to be shamefully poor. Ask yourself this, if you cannot trust the people you work with, because you know they are engaged in wrongdoing, how productive will you be? Then ask this: if you had no other choice but to become silently complicit in the wrongdoing, how productive would you be? In conclusion, while organisational wrongdoing has no personal consequences for the perpetrators, UK productivity will remain low.
