The 𝐓𝐞𝐱𝐚𝐬 𝐃𝐚𝐭𝐚 𝐏𝐫𝐢𝐯𝐚𝐜𝐲 𝐀𝐧𝐝 𝐒𝐞𝐜𝐮𝐫𝐢𝐭𝐲 𝐀𝐜𝐭 takes effect today and grants Texas residents several key rights over their personal data. Companies doing business in or with Texas residents should take note of their new #privacy and #security obligations as it relates to personal data. At a high-level, new consumer rights under the Act include: ◾ 𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒐𝒑𝒕 𝒐𝒖𝒕 of the processing of personal data for purposes of 𝘵𝘢𝘳𝘨𝘦𝘵𝘦𝘥 𝘢𝘥𝘷𝘦𝘳𝘵𝘪𝘴𝘪𝘯𝘨, the 𝘴𝘢𝘭𝘦 𝘰𝘧 𝘱𝘦𝘳𝘴𝘰𝘯𝘢𝘭 𝘥𝘢𝘵𝘢, or 𝘱𝘳𝘰𝘧𝘪𝘭𝘪𝘯𝘨 in furtherance of a decision made by the company concerning the consumer that results in the provision or denial of certain services or employment opportunities; ◾ 𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒌𝒏𝒐𝒘 whether a company is processing the consumer’s personal data and to obtain the personal data in a readable format; ◾ 𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒄𝒐𝒓𝒓𝒆𝒄𝒕 inaccuracies in the consumer’s personal data, taking into account the nature of the data and the purposes for processing the data; ◾ 𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒅𝒆𝒍𝒆𝒕𝒆 personal data provided by or obtained about the consumer; ◾ 𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒏𝒐𝒕 𝒇𝒂𝒄𝒆 𝒓𝒆𝒕𝒂𝒍𝒊𝒂𝒕𝒊𝒐𝒏 𝒐𝒓 𝒅𝒊𝒔𝒄𝒓𝒊𝒎𝒊𝒏𝒂𝒕𝒊𝒐𝒏 for exercising these rights. Fortunately, no private right of action for violation as the Texas Attorney General has the exclusive authority to enforce. There is a 30-day notice and opportunity to cure that the TX AG must provide. A company that violates the Act following a cure period is liable for a civil penalty of up to $7,500 per violation, with the ability for the TX AG to seek attorney's fees and costs in any enforcement action. DELETE ME California Gov. Gavin Newsom has signed a law enabling residents to get data brokers to delete their personal information with just one request, rather than the multiple asks they had to make before. The law is known as the Delete Act. At the Los Angeles Times, Queenie Wong noted it’s “tough for consumers to know which data brokers have their personal data, and businesses might deny a deletion request.” The law directs the California Privacy Protection Agency to make the single-request approach possible by January 2026. “Data brokers include businesses that gather and sell people’s personal data such as addresses, spending habits and employment status. Roughly 500 data brokers are registered in California, and these businesses include everything from people-search sites to analytic firms that work with political campaigns,” Wong reported. The politics: There are many dimensions to this, but one is that law enforcement has increasingly gone to data brokers for information they might have needed a warrant to get otherwise — but that people willingly (or unknowingly) give the brokers. Next week I'll be speaking on a panel at the IRMS - Information and Records Management Society Conference in #Brighton, about #ImposterSyndrome with the awesome 🖖🏼 Scott Sammons, Georgina Daugherty and David Smith. And, of course, I feel there are so many people who would be a better choice than me to be on the panel - ironic, huh? 🤦♀️ In preparation I've been reading about imposter syndrome, and how to harness it instead of letting it keep me nervous. I've still got a few days to go, so I'm not quite there yet! But I am feeling a little bit braver about speaking up, because (according to my reading) having imposter syndrome shows I care about getting things right! One thing I have to admit I downplay quite a bit is my book "A Practical Guide to #DataProtection in #SocialHousing". So while I'm still offering it at the discounted rate (I know, I said I wouldn't have any more available but two people have asked for it recently, so I will get another ten to sell at cost), I'll try to downplay it less! The preface starts with “I’m passionate about data protection because at its core it’s about protecting people”. As we discussed at the February 2024 IRMS Information Rights event, data protection has a ‘PR’ problem. This can perhaps be illustrated by imagining the book had the title ‘Protecting People in Social Housing’. I have seen stats that show 16.4% of households in England are occupied by social renters. That’s a lot of people and those people deserve to be treated with fairness, respect and dignity, which is exactly what the data protection law seeks to ensure.
