Probate is not just for the deceased; it is also for the living who cannot care for themselves. This type of Probate is often referred to as Living Probate because the Court is making legal determinations for a living person. If you die and you have minor children, the Probate court will assign a guardian and conservator to care for your children and their finances until they are 18 years old. If you are incapacitated, meaning you cannot make your own legal, financial, and medical decisions, the Probate court will assign a guardian and conservator to care for you. They will also assign a guardian and conservator to care for your children and their finances until they are 18 years old. There’s good news about Living Probate… You can control who gets to be your guardian and conservator. You can also control who gets to be your children’s guardian and custodian. How?
