The South Carolina Department of Social Services is seeking the services of attorneys interested in providing probate-court related legal services to vulnerable adults in DSS custody on a case-by-case basis, as needed. These vulnerable adults require the appointment of a guardian and/or conservator through probate court to remain stable and protected when less restrictive alternatives are not sufficient given the adult’s conditions and/or circumstances. Ideal candidates will have 5 years or more of direct experience in applicable probate court work. Candidates must be able to perform all duties associated with court appearances, hearing preparation, discovery, legal advice, coordinating and obtaining the other parties necessary for G&C petitions such as attorneys, GAL, the appointee nominees, attend and participate in agency staffings as necessary to secure the appointments, and all other required work associated with completing the probate appointments for the adult. A standard legal services agreement for each referred case is required. If interested, please email your resume and cover letter outlining your applicable experience and interest in serving these vulnerable members of our community to Emma.Belcher@dss.sc.gov by May 31, 2024.

Probate is not just for the deceased; it is also for the living who cannot care for themselves. This type of Probate is often referred to as Living Probate because the Court is making legal determinations for a living person. If you die and you have minor children, the Probate court will assign a guardian and conservator to care for your children and their finances until they are 18 years old. If you are incapacitated, meaning you cannot make your own legal, financial, and medical decisions, the Probate court will assign a guardian and conservator to care for you. They will also assign a guardian and conservator to care for your children and their finances until they are 18 years old. There’s good news about Living Probate… You can control who gets to be your guardian and conservator. You can also control who gets to be your children’s guardian and custodian. How? Having an Estate Plan that includes a Will, Financial Power of Attorney, Health Care Power of Attorney and Guardianship Nominations.
