Frozen cheesecake bites. Something that probably very few people have considered for VAT purposes. Actually, it’s quite interesting… Schedule 8 of the Value Added Tax Act 1994 provides for a general zero rate for food. Certain items are, however, excluded and thus standard-rated. These are the “Excepted items”. Excepted item 1 provides: “Ice cream, ice lollies, frozen yogurt, water ices and similar frozen products, and prepared mixes and powders for making such products.” Excepted item 2 provides: “Confectionery, not including cakes or biscuits other than biscuits wholly or partly covered with chocolate or some product similar in taste and appearance.” In the case of Ross Young Holdings, the Tribunal construed “similar frozen products” as applying to the entire preceding list, rather than reading it disjunctively (i.e. just similar to “water ices”). In the case of Meschia’s Frozen Food, the Tribunal held that the defining characteristic of Item 1 was being eaten below the freezing point of water. As to cakes, we know the zero rate applies to a broad variety of cakes (rather than the mere archetypal sponge), including but not limited to fruit and nut brownies, eclairs, meringues, jaffa cakes, marshmallow teacakes, cornflake cakes, tiffin bars, and millionaires shortbread (see for e.g. para 3.4 HMRC’s Notice 701/14). So, what about cheesecakes that are frozen? Are they cakes? Are they “similar frozen products”? Well, usefully HMRC’s view is set out in manual VFOOD5540: “Frozen cheesecakes which are usually eaten fully defrosted are zero-rated. A recent development has been the introduction of cheesecake type desserts which can be eaten either straight from the freezer or after just a few minutes at room temperature. These are zero-rated as they are more akin to traditional cheesecakes than to ice cream, ice lollies, frozen yoghurt and water ices.” In essence, where a product can fall within two VAT Act categories, it should be placed on the category to which it is “more akin” (see Woolf LJ in Ferrero U.K. Ltd (1997)). A cheesecake is a cheesecake, regardless of its temperature; a frozen cheesecake shares more characteristics with normal cheesecake than with ice creams. What do you think?
