Effective July 17th, the USPTO issued new guidance on patent subject matter eligibility for AI inventions. Superficially, the Guidance appears to merely memorialize current USPTO approaches to determining patent eligibility of AI-tied claims. However, deeper review of the USPTO’s “analysis” in combination with the associated fact patterns in the provided examples illuminates significant and troubling changes to AI patent eligibility at the USPTO. Initially, the new guidance and examples only directly address patent eligibility of hardware implementing AI and specific applications of AI, and indirectly address patent eligibility of AI itself. To clarify, by "AI itself" I am referring to the type of AI used, the structure of that AI, and the training of that AI. Further, in the USPTO analysis of their example claims, AI itself is treated as an abstract and non-technical feature. This treatment by the USPTO neglects the actual source of innovation in many AI-tied inventions, namely the AI itself. By eliminating this key feature of innovation from the eligibility analysis, the USPTO is shutting their eyes to the present state of innovation. In light of this guidance, applicants should expand discussion of ties to a practical application as well as discussion asserting the unconventional nature of those ties to the practical application. These ties to a practical application should at least be recited in limitations in dependent claims. Given the USPTO’s typical lag between policy making and implementation, it may well be several years before the impact of this guidance is felt. However, this guidance represents a significant shift in the USPTO’s evaluation of AI patent eligibility, and this shift should be considered in the preparation of all new AI-tied applications. https://lnkd.in/gwj-sQZj
