Under article 19(1) the Court must ascertain its jurisdiction in all cases. But challenges to that jurisdiction and the filing of observations are limited by paragraphs (2) and (3) of the Rome statute. So not only is there no basis under the Rome Statute —despite the protestations of delegation theorists to the contrary— to suggest that there is no jurisdiction in the Palestine situation over Israeli nationals alleged to have committed ICC crimes on Palestinian territory (as the Court has already essentially held in the Afghanistan situation as well as others.), but the pretrial chamber should not have allowed in the through the back door of rule 103 what the statute itself does not permit. The net result of the UK’s maneuver has been confusion and delay. Hopefully the PTC will sort it out quickly. States do not transfer bits and pieces of their jurisdiction to the ICC. Rather, upon accession or ratification (or by declaration) they confer jurisdiction upon the Court and the Rome statute therupon applies in its entirety. https://lnkd.in/gYC-fMh5

A fascinating part of this case (and indeed generally) is how to set a requisite level of punishment that captures the stature of the crime committed. This one is crucial. The bench mark should be pushed as high and as hard as possible to make evident that the nature of this crime (and those similar) will no longer be tolerated under any circumstances. This is likely to set an important legislative reference point.

In cases of street fights, neighbor disputes, or any heated argument between individuals or groups that may escalate into a fight, it is always advisable to involve the police. In such situations, be the first to call the police and demonstrate that you understand and acknowledge that cops are not merely a means for case registration, but also a mechanism to de-escalate any heated situation and establish peace and harmony in society. Furthermore, the call made to the police becomes extremely important as evidence to establish a "proactive-peace-seeking" conduct of the person. Remember, these calls are recorded, and subsequently, a brief statement is made stating the name, date, time, and purpose of the call.
