For Law Students: 40+ Agreements used in the Film industry Ever wondered what kind of agreements are used for signing actors, directors, producers or making movies? Following is an extensive but not exhaustive list of agreement templates used in the film industry. These are the templates used by nationally listed companies in the United States (Hollywood etc.) and disclosed in the public domain as a part of the regulatory requirements. Some aspects of movie agreements like rights of junior artists or production staff are subject to local laws, hence anyone seeking to customize this may consider removing or editing such aspects. As a FILMMAKER, you do not need a lawyer. Yes, you heard me right. You do not need a Lawyer because what you need is a FILM LAWYER. A Lawyer may not: ❌ Understand film laws ❌ Understand the intricacies of the film industry ❌ Understand film transactions ❌ Be familiar with film contracts But a film Lawyer would definitely: ✅ Understand the nitty-gritty of film laws ✅ Understand the ins and outs of the film industry ✅ Be used to film transactions ✅ Be familiar with most film contracts Don’t sacrifice your business interest on the altar of familiarity and cheap labour. The fact that your Uncle has been practising law for the past 20 years does not automatically qualify him to draft or review your film agreements. Instead, choose a Lawyer who has a deep understanding of the industry and ample experience in film related transactions. You can’t organize a film related seminar in 2024 and not have a film lawyer on your Speaker’s list. If you do such, it means: 1️⃣ You want your audience to start a film business without knowing the right legal structure to choose. 2️⃣ You want them to create intellectual property in the form of films and remain clueless about how to protect it. 3️⃣ You want them to keep signing contracts without understanding the implications of what they are signing. 4️⃣ I mean you want them to keep making films without showing them the strategic ways to protect themselves and their business against the numerous risks associated with filmmaking. Accelerate Studios understood the critical roles legal and IP knowledge plays in the lives and careers of filmmakers. Indian film producers get entangled in legal conflicts over the distribution of profits, intellectual property rights, and breaches of revenue-sharing agreements. These issues frequently arise on account of inadequately drafted co-production agreements or informal commercial understandings that have not been documented in writing, resulting in ambiguity and the potential for disagreements. Plans underway to grant film commission full autonomy: Amid concerns about the legal status of the Namibia Film Commission (NFC), the government has announced plans to grant the commission full autonomy in the coming months. Concerns have been raised that the Namibia Film Commission Act (6 of 2000), which established the commission, has never been enacted. An anonymous legal consultant says the act was never properly implemented, with the commission’s operations only starting in 2004 triggered by the making of the film ‘Namibia – The Struggle for Liberation.’ The consultant referenced a 2019-article by the Legal Assistance Centre which says the parliament often passes laws that will come into force on a future date set by the relevant minister. This system is generally beneficial as it allows time to establish administrative bodies and write regulations after the law’s content is finalised. This process, however, can enable the executive to undermine the legislature’s decisions or to act without proper legal authority. “I would think that an organisation that does not exist legally would have no authority to, for instance, enter into contracts or engage in other legal transactions,” the consultant says. However, Ministry of Information and Communication Technology spokesperson Shoki Kandjimi says the act enabled the NFC’s operations. He says the ministry is in the process of giving the NFC full autonomy. “We are cognisant of the situation the NFC faces. . . We hope that the commission will in the next months become a fully fledged public entity with strong support from the government, to respond to the needs of the industry,” Kandjimi says. He says the ministry will be looking at ways to increase the commission’s funding. “It is important to reiterate our commitment towards developing the creative industry through areas such as the Film Development Fund,” Kandjimi says. The NFC received a budget of N$6 million from the fund. However, between 2004 and 2007, the government made N$80 million available for the creation of ‘Namibia: The Struggle For Liberation’. This was the highest amount the NFC has spent on a single film since. Kandjimi justifies the amount, saying it was a worthwhile investment, not only for the country’s history, but also for growing an industry where there was none. “Many of our veteran film practitioners got their debut experiences from that project and they are doing very well today. We are truly proud that Namibia was able to execute an award-winning project which put us on the map in terms of quality and talent against the backdrop of a sought-after film location,” Kandjimi says. Meanwhile, the NFC is currently faced with the appointment of a new board, which was delayed when communication minister Emma Theofelus blocked the appointment of two board members on the grounds that they previously served on the board. You definitely don’t know this about me🤔 Yes, you don’t know how much joy I derive from chatting with filmmakers about the legal aspect of filmmaking. I mean I felt super elated when the Ebonylife Creative Academy invited me to speak with the Producers in making about filmmaking and the law. Trust your favorite film lawyer, I started with making them understand that they are not just filmmakers but value creators because if they don’t see value in what they create, they will feel no need to protect it legally. I then proceeded to enlighten them about: 1️⃣ The best legal structure for their film business; 2️⃣ How to protect and monetize their films and brand; 3️⃣ How to use contracts to protect their business interest; 4️⃣ How to identify, protect and monetize their intellectual property.
