Absent the clever humor, I'd focus the requirement of citation to authority, a surprisingly common omission. Query: Did the defendant have to argue for the overruling of Austin, the binding supreme court case, in his opening brief on his intermediate appeal, in order to preserve the issue if leave to further appeal is allowed?
𝐈𝐥𝐥𝐢𝐧𝐨𝐢𝐬 𝐀𝐩𝐩𝐞𝐥𝐥𝐚𝐭𝐞 𝐏𝐫𝐚𝐜𝐭𝐢𝐜𝐞 𝐓𝐢𝐩𝐬: 𝑩𝒊𝒏𝒅𝒊𝒏𝒈 𝒑𝒓𝒆𝒄𝒆𝒅𝒆𝒏𝒕 Even when a point of law in your brief seems obvious and uncontroversial, you should still include an appropriate citation to authority. This week, the Second District Appellate Court gifted us with 𝑃𝑒𝑜𝑝𝑙𝑒 𝑣. 𝑀𝑜𝑒𝑙𝑙𝑒𝑟, 2024 IL App (2d) 230043, the decision that I will now cite whenever I state the proposition that lower state courts are “bound to faithfully follow and apply judicial precedents established by our supreme court.” 𝐼𝑑. at ¶ 150.
