One for the FOIA aficionados. When is information about a government policy or policies information which relates to its formulation or development (and which, thus, engages the section 35 exemption), and when is it, instead, only information about its implementation. The Upper Tribunal comes good for the Cabinet Office at the last hour (after having initially refused permission to appeal) and holds that information on polling of the general public on their perception of the strength of the Union (between Scotland and the RoUK) was not implementation of a settled policy, but was, in terms, “follow-on policy formulation”.
