In this video, I talk about the tax-deferring strategy called 1031 exchange. 1031 exchanges offer an excellent tax deferral strategy for real estate investors by allowing gains from sold properties to be rolled into new investments. However, when it comes to syndications, implementing 1031 exchanges can be more complex. This is because investors hold a security or membership interest in an entity rather than direct real estate ownership. A standard 1031 exchange requires a like-kind exchange from property ownership to property ownership. To navigate this challenge, we at Lone Star Capital utilize a structure called tenancy-in-common (TIC), which allows us to facilitate 1031 exchanges into our syndications seamlessly. Real Estate Sector became a heaven for black money earners after 2001-2 when wealth tax was abolished. Wealth tax was applicable on individuals having net wealth in certain millions (say Rs 2.5 Mln approx) and tax slabs were 0.50%, 1.00%, 1.50%, 2.00% and 2.50% on each succeeding Rs 500,000 till Rs 5 Mln and flat rate of wealth tax of 2.50% above Rs 5 Mln. To simplify and understand the story of increase of prices in real estate sector, it is a fact that BAHRIA Town Sector B Lahore was launched in 2001 and price of 8 marla plot was Rs 182,000 in 8 quarterly instalments along with 20% down payment. After development charges, recovered subsequently, its price was ranging Rs 350,000 to Rs 400,000. Bahria Town price had been quoted for the sake of being a known brand all over Pakistan and to compare the state of affairs at that point in time in other societies, colonies and mohallas and comparison with current state of affairs all over Pakistan. Mushroom growth of societies all over Pakistan raised rates of plots exorbitantly and attracted nearby villages and villagers to sell their agricultural land over the last 2 1/2 decades to real estate investors. This development damaged agricultural sector on the one hand and industrial sector on the other hand due to abnormal profits (capital gain being exempt from income tax) and easy business. Now the real estate sector is facing slump while initial investors earned too much profits and have no worries while buying of a plot for residential purposes by a common man became a dream. It’s not too late to take corrective action and chalk out next 25 years plan to develop and compete the societies in pipeline with certain new conditionalities. 1. Standardisation of amenities within the societies, like sewarage, water, electricity, gas , mosque, road maintenance and garbage collection and disposal. 2. Mergers of nearby societies in order to provide the requisite aforesaid amenities on collective basis, 3. Low cost construction design and multi-story provsioning from the day one in map to take care of expansion in families. 4. Societies be bound to construct 1-2 multistory apartments to maximise use of land and housing requirements. 5. Societies be bound to construct multistory commercial area to fulfill all basic necessities of life therein and avoiding outside unnecessary travelling. 6. There should be complete ban on new housing societies all over Pakistan and development & construction activities must be promoted. 7. HBFC and financial institutions should be bound to allow only one loan for the construction of own house with concessionary mark-up and 10-25 years repayment. 8. The SOPs of DHA & Bahria Town are already in practice and guidelines may be taken from their respective rules and regulations. It is duty of the current ruling parties to take care of the general public and should be obliged to them for trusting and placing them in power corridors.
