After today's vote in EU Parliament in the first reading the #EUDR applicability postponement to end of 2025 remains questionable. Although EU Parliament voted in favour of the postponement and in favour of certain additional amendments (e.g. "no-risk" countries) proposed by political groups, this caused that the whole bundle of amendments will be discussed in interinstitutional negotiations called "trilogue" and will eventually have to be endorsed by EU Parliament and Council. It is hard to guess the final outcomes and whether the final conclusion can be reached by the end of this year.
What’s next for the #EUDR after today's vote in the European Parliament? The #EuropeanParliament approved the #EuropeanCommission’s proposal to delay the EUDR by 12 months, but crucially also adopted other amendments to the legislation. That means the Commission, #EuropeanCouncil and Parliament now need to negotiate the amended legislative file via trilogues. From a legislative perspective, the amendments have not been finalised and the original text (and 2024 deadline) still stands for now. We're still waiting for the dust to settle after the Parliament’s vote today, but based on what we've seen so far, the small set of amendments and the agreement to a one-year delay (rather than longer) means that the amendments now on the table are likely palatable to all three institutions. That said, there is still the possibility that one or other of the institutions will want to open up some of the points for deeper or further discussion when trilogues begin. So: ✅ Companies can have a fair degree of confidence now to move forward on the basis that there will be a one-year delay. It seems likely that the one year delay will eventually be adopted. ✅ The greater risk is that the delay is not implemented in time to allow for publication in the EU Official Journal before December 30, 2024. Amongst the other amendments approved by the Parliament is a new risk category for countries posing "no risk" on deforestation. Companies may want to start to factor this into their planning, but should wait until a final legislative decision before relying on the new category.
