One of the questions I get asked the most by my Clients is the following: Can I transfer my home to my children? Whilst I appreciate my Clients concerns with regards to the payment of Inheritance Tax (IHT) and/or care fees, there are so many reasons why I advise Clients to think carefully before doing this and I list a few of these below: - If they fall out with their Children they could lose their home. - If their Children are married and the marriage breaks down, their home will become an asset of the divorce. - It could be deemed a Gift with Reservation of Benefit and ineffective for IHT purposes. - They will lose control of their home. - It could be deemed a Deliberate Deprivation of Asset for care fees and still be taken into account when being assessed for funding. This is not an exhaustive list of the considerations but highlight some of the key factors which need to be taken into account. "I'm separating from my spouse, so when should I redo my Will?" The answer is immediately! Once divorced, your Will remains valid. However, your spouse is now treated as if they are dead. Whilst you might like that idea, this can have a serious effect on your estate. If your Will doesn't specify what happens in the event of your ex-partners death, the rules of intestacy could apply. The real danger period, however, is during a separation when the terms of your Will are still valid. You may not wish for them to benefit, but they still would. As with any changes to your circumstances, we would suggest you write a new Will as a priority to ensure the beneficiaries are who you want - and not your ex.
