Last Friday, following the end of the enforced silence brought about by #GE24, which the Civil Service calls Purdah, we saw the Monthly Management Information data from HM Courts & Tribunals Service (HMCTS) for the 13 months to May 2024, link below. As expected these statistics provide the same old, same old grim evidence that nothing the Government has tried so far has eradicated the Backlog. An average of ca 1 year to a first hearing of a Small Claims case. In reality it's 2 years with lost paper files and lost judges (the judicial recruitment crisis continues seemingly without end) causing chaos. For higher value cases the wait time is far longer. Mandatory mediation in the Small Claims Track (SCT) should have an effect but do not expect to see much improvement before we reach the annual high in September. To judge whether that works look to the stats published in June 2025, 1 year after the start of mandatory mediation. Much depends on whether the infrastructure that HMCTS have put in place holds up under the strain of vastly increased numbers. There is no platform to manage these mediations only 20th century technology of telephone and email. The introduction of near mandatory mediation in the higher value claims from October 2024 will help too. The most effective way to remove the Blight of the Backlog is near mandatory mediation in pre-action which is the recommendation of the Civil Justice Council's (CJC's) Pre-Action Protocol Working Group's Final Report, Part I. Published almost 1 year ago we continue to wait for Part 2 and then, action. I hope the 2nd Part of the CJC Report will be published before the end of this Legal Year in 2 weeks' time or before the start of the next Legal Year on 1 October. The Civil Procedure Rule Committee (CPRC) can then get on with the work of implementing the reformed Pre-Action Protocol (PAPs) which will lead to the billions of £££ tied up in the Backlog being released to fuel the economic growth this country desperately needs. Expansion of the Swedish FDI Scope from September 1st The Civil Contingencies Agency has made amendments to the administrative provisions on what constitutes essential services under the Swedish FDI Act - and thus triggers filing obligation under the act. The amended provisions expand the scope of the FDI Act through adding activities in a wide-ranging set of fields, for example electronic alarm systems, the supply of healthcare information and medical advice over the internet or telephone, travel agency services and invoicing services for emergency response authorities or entities carrying out security-sensitive activities. The scope of the information and electronic communications services field has been broadened quite a bit. By way of example, the new scope will cover: - operations, maintenance and provision of public electronic communications and publicly available electronic communications services, if these activities are subject to notification under the Swedish Electronic Communications Act (2022:482), - operations, maintenance and provision of electronic communications networks in fibre or broadband associations, - the supply of number-independent interpersonal communications services, - activities in IT operation services relating to the operation, maintenance or provision of cloud services, data server services, or outsourced web or server services for emergency response authorities, regions, municipalities or activities covered by the NIS2 directive, - specialized IT or data services conducting data recovery or destruction services, or IT/security auditing, - data processing activities, such as the supply of databases or data management for national registers, or automatic scanning of data for authorities or companies, - collection, processing or storage of genetic or biometric data, - and more... Changes to the MiFIR Reporting Obligation (Article 26) are making their way through the European legislative process, with a reading and debate in the European Parliament on 15th January, with a vote cast on 16th January. The proposed changes have been provisionally agreed. The changes are now being put forward the European Council, the European Commission and the national Parliaments. The MiFIR updates are progressing as expected and we can now expect for the drafting of an updated RTS 22. House support for the Technology Modernization Fund (TMF), a federal initiative aimed at upgrading and modernizing government IT systems, has declined as it has been omitted from the initial draft of the fiscal 2025 Financial Services and General Government spending bill. This means the House is not considering the Biden administration's $200 million request for the TMF. Previously, Senate lawmakers had eliminated TMF funding and retracted $100 million from the 2024 appropriations bill. In January, the PRA published a new Consultation Paper 2/24 (CP2/24) on solvent exit planning for insurers. The CP consults on new rules and expectations that firms must prepare for a solvent exit as part of BAU and document these in a Solvent Exit Analysis (SEA). There are also new expectations that if a solvent exit becomes a reasonable prospect, then a firm should prepare a detailed Solvent Exit Execution Plan (SEEP) and then monitor and manage a solvent exit. The proposals would apply to all PRA-regulated insurers except for firms in passive run-off and UK branches of overseas insurers. The resulting Policy Statement is expected in the second half of 2024 and the implementation date is expected to be in Q4 2025, giving firms approximately 18 months to prepare for the changes. This paper considers the proposals and gives the authors’ views and observations on them, including what we believe are the takeaways for insurers.
