🚫 Wage Theft will become a Criminal Offence: From 1 January 2025, employers may be guilty of an offence and face criminal charges if they engage in ‘wage theft’. Wage theft can occur when an employer intentionally withholds payment from an employee or pays them less than what they are entitled to. Wage theft can also involve withholding entitlements such as long service leave; not paying penalty rates or overtime; not making superannuation contributions or underpaying these contributions; refusing to grant leave; deducting cash from wages unlawfully, such as to pay for till shortages; paying cash in hand and not documenting an employee’s requirements correctly, and not paying staff at all. If conduct is found to be intentional, employers may face a term of up to 10 years imprisonment, a maximum fine of up to $7.8M or 3x the amount that was underpaid if that amount exceeds the maximum fine. Penalties will not apply to employers who make honest mistakes or unintentionally underpay employees. New legislation – About Wage Theft Fair Work for All: Australia’s Crackdown on Wage Theft The Australian workforce is about to witness a significant shift in employee protection. The Federal Government has taken a bold step to address the long-standing issue of wage theft, proposing to criminalise this practice nationwide. 🧐 What’s Changing? As part of the Closing Loopholes Bill, deliberate underpayment of workers will soon be classified as a criminal offence. This move aims to eliminate the double standard where employee theft is criminalised, but employer theft often goes unpunished. 👉🏼 Key Points: The new legislation is set to take effect no later than January 1, 2025. It will only apply to cases of intentional underpayment. Penalties for companies could reach up to $7.825 million or three times the underpayment amount, whichever is greater. Individuals found guilty may face up to 10 years in prison and fines of up to $1.565 million. 🤔 What Constitutes Wage Theft? Effective July 1, 2024, the U.S. Department of Labor's new salary level regulations are now in effect, raising the salary threshold for white-collar exemptions from $35K to around $44K. Although facing legal challenges, a temporary order issued on June 28 in Texas v. DOL applies solely to state workers in #Texas. Employers must adhere to the new salary requirements until further notice. We anticipate additional lawsuits across the country seeking broader injunctions and potential appeals to the 5th U.S. Circuit Court of Appeals. Given the narrow scope of the current order, litigation challenging the Overtime Rule is expected to intensify, with possible outcomes that could alter the rule before the January 1 effective date for Phase II.
